Sunan al-Kubra Bayhaqi 12570
(12570) The words of a narration are: The Messenger of Allah (peace and blessings of Allah be upon him) came to me when I was ill. I said: O Messenger of Allah! Shall I bequeath all my wealth (as a will)? He (peace and blessings of Allah be upon him) said: No. I said: Then two-thirds? He (peace and blessings of Allah be upon him) said: No. I said: One-third then? He (peace and blessings of Allah be upon him) remained silent. So, I made a will for one-third.

(١٢٥٧٠) ایک سند کے الفاظ ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) میرے پاس آئے اور میں مریض تھا۔ میں نے کہا : اے اللہ کے رسول (صلی اللہ علیہ وآلہ وسلم) ! میں اپنے سارے مال کی وصیت کر دوں ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں۔ میں نے کہا : دو ثلث کی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں، میں نے کہا : ایک تہائی۔ آپ (صلی اللہ علیہ وآلہ وسلم) خاموش رہے، پس ثلث کی وصیت کی تھی۔

١٢٥٧٠ - أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، أنا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا مُحَمَّدُ بْنُ عُبَيْدِ اللهِ الْمُنَادِي، ثنا وَهْبُ بْنُ جَرِيرٍ، ثنا شُعْبَةُ، عَنْ سِمَاكٍ، عَنْ مُصْعَبِ بْنِ سَعْدٍ،عَنْ سَعْدٍ قَالَ:نَزَلَتْ فِيَّ أَرْبَعُ آيَاتٍ،فَذَكَرَ الْحَدِيثَ قَالَ:وَدَخَلَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَلَيَّ وَأَنَا مَرِيضٌ،فَقُلْتُ:يَا رَسُولَ اللهِ، أُوصِي بِمَالِي كُلِّهِ؟قَالَ:" لَا "،قُلْتُ:فَبِثُلُثَيْهِ؟قَالَ:" لَا "،قُلْتُ:فَبِثُلُثِهِ؟قَالَ:فَسَكَتَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَكَانَ الثُّلُثُ. أَخْرَجَهُ مُسْلِمٌ
