Sunan al-Kubra Bayhaqi 14445
Qadi Shurayh said: Ali (may Allah be pleased with him) asked me: Who is meant by الَّذِی بِیَدِہِ عُقْدَۃُ النِّکَاحِ (the one in whose hand is the marriage tie)? I said: The guardian (of the bride). He said: No, rather it is the husband.

(١٤٤٤٥) قاضی شریح کہتے ہیں کہ حضرت علی (رض) نے مجھ سے پوچھا : الَّذِی بِیَدِہِ عُقْدَۃُ النِّکَاحِ سے کون مراد ہے ؟ میں نے کہا : وہ ولی ہے۔ فرمانے لگے : نہیں بلکہ خاوند ہے۔

١٤٤٤٥ - أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ،وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا:ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ، ثنا عُبَيْدُ اللهِ بْنُ عَبْدِ الْمَجِيدِ، ثنا جَرِيرُ بْنُ حَازِمٍ، ثنا عِيسَى بْنُ عَاصِمٍ،عَنْ شُرَيْحٍ قَالَ:سَأَلَنِي عَلِيٌّ رَضِيَ اللهُ عَنْهُ عَنِ الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ قَالَ: قُلْتُ: هُوَ الْوَلِيُّ قَالَ:" لَا بَلْ هُوَ الزَّوْجُ "
