Chapter on one who said: The one who holds the contract of marriage is the guardian
باب من قال الذي بيده عقدة النكاح الولي
Sunan al-Kubra Bayhaqi 14460
Akarmah narrates that Allah commanded: "She (the wife) should either forgive (the remaining dowry) or he (her guardian) should allow (it to be remitted). If she forgives, then it is permissible. And if she withholds it, and her guardian allows (it to be remitted), then that is also permissible." (b) The first opinion is more correct. {Or let him (her husband) forgo it (the dowry) by whom the marriage contract was given.} [Al-Baqarah 237].

(١٤٤٦٠) عکرمہ فرماتے ہیں کہ اللہ نے حکم فرمایا : وہ عورت معاف کرے یا اجازت دے۔ اگر معاف کرے تب بھی جائز ہے اگر بخیلی کرے اور اس کا ولی معاف کر دے تب بھی جائز ہے۔ (ب) پہلا قول زیادہ صحیح ہے۔{ اَوْ یَعْفُوَا الَّذِیْ بِیَدِہٖ عُقْدَۃُ النِّکَاحِ } [البقرۃ ٢٣٧]
(14460) Akrma farmate hain ki Allah ne hukm farmaya: woh aurat maaf kare ya ijazat de. Agar maaf kare tab bhi jaiz hai agar bakhili kare aur uska wali maaf kar de tab bhi jaiz hai. (b) Pehla qaul zyada sahi hai. {aw ya fuoal lazi bi yadihi uqdato an nikah} [albaqarah 237]
١٤٤٦٠ -قَالَ:وَحَدَّثَنَا سَعِيدٌ ثنا جَرِيرٌ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ قَالَ:" هُوَ الْوَلِيُّ "، وُرُوِّينَا هَذَا الْقَوْلَ أَيْضًا عَنْ أَبِي الشَّعْثَاءِ وَالزُّهْرِيِّ وَهُوَ قَوْلٌ، وَإِلَيْهِ كَانَ يَذْهَبُ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي الْقَدِيمِ ثُمَّ رَجَعَ فِي الْجَدِيدِ إِلَى الْقَوْلِ الْأَوَّلِ وَهُوَ الْقَوْلُ الْأَصَحُّ وَاللهُ أَعْلَمُ بِالصَّوَابِ
