Sunan al-Kubra Bayhaqi 15600
Rabi'a bint Muawwidh (may Allah be pleased with her) narrated that she performed khul' during the lifetime of the Prophet (peace and blessings of Allah be upon him). She was commanded, or it is more correct to say, it was ruled, that she should observe a waiting period of one menstrual cycle. There is no mention of who issued this ruling, nor are the words "during the lifetime of the Prophet (peace and blessings of Allah be upon him)" present. In the chapter on khul', we have mentioned the narration stating that she performed khul' from her husband during the time of Uthman ibn Affan (may Allah be pleased with him).

(١٥٦٠٠) ربیع بنت معوذ (رض) سے روایت ہے کہ اس نے نبی (صلی اللہ علیہ وآلہ وسلم) کے زمانے میں خلع کیا۔ اس کو نبی (صلی اللہ علیہ وآلہ وسلم) نے حکم دیا کہ وہ ایک حیض عدت گزارے یا اسے حکم دیا گیا۔ یہ زیادہ صحیح ہے اور اس میں نہیں ہے جس نے اس کو حکم دیا اور نہ ہی ” نبی (صلی اللہ علیہ وآلہ وسلم) کے زمانے میں “ کے الفاظ ہیں۔ ہم نے کتاب الخلع میں روایت ذکر کی کہ اس نے عثمان بن عفان (رض) کے زمانے میں اپنے خاوند سے خلع کیا۔

١٥٦٠٠ - وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ، أنا سُلَيْمَانُ بْنُ أَحْمَدَ اللَّخْمِيُّ، نا الْحَسَنُ بْنُ عَلِيلٍ الْعَنَزِيُّ، نا أَبُو كُرَيْبٍ، نا وَكِيعٌ، عَنْ سُفْيَانَ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ مَوْلَى آلِ طَلْحَةَ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنِ الرُّبَيِّعِ بِنْتِ مُعَوِّذِ ابْنِ عَفْرَاءَ، أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا" فَأُمِرَتْ أَنْ تَعْتَدَّ بِحَيْضَةٍ "هَذَا أَصَحُّ وَلَيْسَ فِيهِ مِنْ أَمْرِهَا وَلَا عَلَى عَهْدِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَقَدْ رَوَيْنَا فِي كِتَابِ الْخُلْعِ أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا زَمَنَ عُثْمَانَ بْنِ عَفَّانَ رَضِيَ اللهُ عَنْهُ
