Chapter: The punishment (Hadd) for a man's slave if she commits adultery
باب حد الرجل أمته إذا زنت
Sunan al-Kubra Bayhaqi 17113
Abu Zinad narrates from the jurists of Medina that no one should carry out the punishment of Hadd except the Sultan (governing authority). However, if a man's own slave-girl or slave commits fornication/adultery, then he can carry out the Hadd on them.

(١٧١١٣) ابو زناد فقہاء اہل مدینہ سے روایت کرتے ہیں کہ کوئی کسی کو حد نہ لگائے مگر سلطان اور اگر آدمی کی اپنی لونڈی یا غلام زنا کرلے تو وہ اسے حد لگائے۔
(17113) Abu Zinad fuqaha ehl e Madina se riwayat karte hain ke koi kisi ko had na lagaye magar sultan aur agar aadmi ki apni laundi ya ghulam zina karle to wo use had lagaye.
١٧١١٣ - أَخْبَرَنَا أَبُو الْحَسَنِ الرَّفَّاءُ، أنبأ عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثنا إِسْمَاعِيلُ الْقَاضِي، ثنا ابْنُ أَبِي أُوَيْسٍ، ثنا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنِ الْفُقَهَاءِ الَّذِينَ يَنْتَهِي إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ،كَانُوا يَقُولُونَ:" لَا يَنْبَغِي لِأَحَدٍ أَنْ يُقِيمَ شَيْئًا مِنَ الْحُدُودِ دُونَ السُّلْطَانِ إِلَّا أَنَّ لِلرَّجُلِ أَنْ يُقِيمَ حَدَّ الزِّنَا عَلَى عَبْدِهِ وَأَمَتِهِ "
