Sunan al-Kubra Bayhaqi 18367
Muhammad bin Qais narrates from Sha'bi that in the era of Umar bin Abdul Aziz, a question was raised about the people of Sawad: Was there any treaty with them? He replied that there was no treaty with them, but when Jizya began to be taken from them with their consent, it became a covenant for them.

(١٨٣٦٧) محمد بن قیس اسدی شعبی سے نقل فرماتے ہیں کہ حضرت عمر بن عبدالعزیز کے دور میں اہل سواد کے بارے میں پوچھا گیا : کیا ان کے لیے کوئی عہد تھا ؟ کہتے ہیں کہ ان کے لیے نہیں تھا جب رضا مندی سے خراج لیا جانے لگا تو ان کے لیے معاہدہ بن گیا۔
(18367) Muhammad bin Qais Asadi Shuaibi se naql farmate hain ke Hazrat Umar bin Abdulaziz ke daur mein ahle sawad ke bare mein poocha gaya : kya in ke liye koi ahd tha ? kehte hain ke in ke liye nahi tha jab raza mandi se kharaj liya jane laga to in ke liye muahida ban gaya.
١٨٣٦٧ -قَالَ:وَحَدَّثَنَا الصَّلْتُ بْنُ عَبْدِ الرَّحْمَنِ الزُّبَيْدِيُّ، عَنْ مُحَمَّدِ بْنِ قَيْسٍ الْأَسَدِيِّ، عَنِ الشَّعْبِيِّ، أَنَّهُ سُئِلَ فِي زَمَنِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ عَنْ أَهْلِ السَّوَادِ، أَلَهُمْ عَهْدٌ؟قَالَ:لَمْ يَكُنْ لَهُمْ عَهْدٌ، فَلَمَّا رُضِيَ مِنْهُمْ بِالْخَرَاجِ صَارَ لَهُمُ الْعَهْدُ
