كتاب العتق
Chapter: One who manumits a partner in a slave he co-owns while he is well-off
باب: من أعتق شركا له في عبد وهو موسر.
Sunan al-Kubra Bayhaqi 21339
Shabi says that there was a slave who belonged to two partners. One of them freed his share. It was said that on the day of freeing (the other half), the price will be estimated with justice (and the remaining amount will have to be paid to the other partner).

(٢١٣٣٩) شعبی فرماتے ہیں کہ غلام جو دوبندوں کا تھا، ایک نے اپنا حصہ آزاد کردیا، فرمایا : آزادی کے دن اس کے اوپر عدل والی قیمت مقرر کی جائے گی۔
(21339) shubi farmate hain ke ghulam jo do bandon ka tha, aik ne apna hissa azad kardiya, farmaya : azadi ke din is ke upar adl wali qeemat muqarar ki jayegi.
٢١٣٣٩ -وَبِإِسْنَادِهِ:ثنا أَبُو بَكْرٍ، ثنا يَحْيَى بْنُ آدَمَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، وَالشَّعْبِيِّ، فِي الْعَبْدِ يَكُونُ بَيْنَ الرَّجُلَيْنِ فَيُعْتِقُ أَحَدُهُمَا نَصِيبَهُ،قَالَا:" يَضْمَنُ ثَمَنَهُ لِصَاحِبِهِ بِقِيمَةِ عَدْلٍ يَوْمَ أَعْتَقَهُ "
