Chapter: Inheritance of the scribe and his guardianship.
باب ميراث المكاتب وولائه
Sunan al-Kubra Bayhaqi 21751
Mughirah said: I asked [Imam Sadiq] about a man who died and left behind a slave, and his heirs freed the slave. Does the right of ownership [of the slave] belong to the heirs? He said: The right belongs to the deceased.

(٢١٧٥١) مغیرہ کہتے ہیں کہ میں نے ابراہیم سے سوال کیا کہ آدمی فوت ہوجائے، اس کے مکاتب کو چھوڑا تو ورثاء نے مکاتب کو آزاد کردیا تو ولائکس کا حق ہے ؟ فرمایا : میت کا حق ہے۔
21751 Mugirah kahte hain ke maine Ibrahim se sawal kiya ke aadmi faut hojae, uske maktab ko chhora to warasa ne maktab ko aazaad kardiya to wilayat ka haq hai? Farmaya: Mait ka haq hai.
٢١٧٥١ -قَالَ:وَأنبأ ابْنُ الْمُبَارَكِ، أنبأ عَمَّارُ بْنُ رُزَيْقٍ، عَنِ الْمُغِيرَةِ،قَالَ:سَأَلْتُ إِبْرَاهِيمَ عَنْ رَجُلٍ تُوُفِّيَ وَتَرَكَ مُكَاتَبًا فَأَعْتَقَ الْوَرَثَةُ الْمُكَاتَبَ بِمَا يُصِيبُهُ مِنَ الْمِيرَاثِ، لِمَنِ الْوَلَاءُ؟قَالَ:" لِلْمُكَاتَبِ الْمَيِّتِ "
