Chapter: Inheritance of the scribe and his guardianship.
باب ميراث المكاتب وولائه

Ibrahim said: A man made a contract of manumission with his slave. The slave who made the contract of manumission died, leaving behind men and women (as heirs). He (Ibrahim) said: The women will not get anything from the manumission, but the inheritance will be distributed among the men and women.

(٢١٧٥٠) ابراہیم فرماتے ہیں کہ ایک شخص نے اپنے غلام سے کتابت کی۔ مکاتبت کرنے والا شخص مرگیا، اس نے اپنے مرد اور عورتیں چھوڑیں۔ فرماتے ہیں کہ مکاتب کی ولاء سے عورتوں کو کچھ بھی نہ ملے گا۔ لیکن میراث مردوں اور عورتوں میں تقسیم ہوگی۔
(21750) Ibrahim farmate hain keh aik shakhs ne apne ghulam se kitaabat ki. Mukatabat karne wala shakhs margiya, usne apne mard aur auratain chhorain. Farmate hain keh mukatab ki wilayat se auraton ko kuchh bhi nah milay ga. Lekin miraas mardon aur auraton mein taqseem hogi.
٢١٧٥٠ -قَالَ:وَأَخْبَرَنَا ابْنُ الْمُبَارَكِ، أنبأ سُفْيَانُ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ كَاتَبَ عَبْدًا لَهُ ثُمَّ مَاتَ الرَّجُلُ الَّذِي كَاتَبَ وَتَرَكَ رِجَالًا وَنِسَاءً،قَالَ:" لَيْسَ لِلنِّسَاءِ مِنْ وَلَاءِ ⦗٥٧٢⦘ الْمُكَاتَبِ شَيْءٌ، وَالْمِيرَاثُ بَيْنَهُمْ "، يَعْنِي الرِّجَالَ وَالنِّسَاءَ.
