Sunan al-Kubra Bayhaqi 21749
Saeed bin Musayyab and Abu Salamah bin Abdur Rahman, both of them said regarding a man who makes a contract of manumission (mukatabat) with his slave, then passes away leaving behind sons and a wife, that the mukatab (slave who entered the contract) will pay his manumission amount to the sons. They said the inheritance will only be received by the men, not the women.

(٢١٧٤٩) سعید بن مسیب اور ابو سلمہ بن عبدالرحمن دونوں ایک آدمی کے متعلق فرماتے ہیں کہ جو اپنے غلام سے مکاتبت کرتا ہے، پھر فوت ہوجاتا ہے اور اپنے بعد بیٹے اور عورت چھوڑتا ہے تو مکاتب اپنی کتابت ان کو ادا کرتا ہے۔ فرماتے ہیں کہ ولاء صرف مردوں کو ملے گی عورتوں کو نہیں۔

٢١٧٤٩ -قَالَ:وَأَخْبَرَنَا ابْنُ الْمُبَارَكِ، أنبأ مَعْمَرٌ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَأَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ قَالَا فِي الرَّجُلِ يُكَاتِبُ مَمْلُوكَهُ ثُمَّ يَمُوتُ وَيَتْرُكُ بَنِينَ رِجَالًا وَنِسَاءً فَيؤَدِّي الْمُكَاتَبُ إِلَيْهِمْ كِتَابَتَهُ،قَالَا:" الْوَلَاءُ لِلرِّجَالِ دُونَ النِّسَاءِ "وَكَانَ ابْنُ شِهَابٍ يَقُولُ ذَلِكَ.
