Sunan al-Kubra Bayhaqi 21787
(21787) Hukm bin Aban narrates that Ukrama was asked about the mothers of the children (Umm al-Walad). He said: They are free. It was said: Why do you say that? He said: Because of the Quran. They asked: What is in the Quran? He said: {O you who believe! Obey Allah and obey the Messenger and those in authority from among you} [An-Nisa 59] Obey Allah and the Messenger and those in authority. Umar was also among the Ulul-Amr. He said: She will be free even if the child is dead. (b) Ibn Abbas (ra) narrated from the Prophet (peace and blessings of Allah be upon him) that the Umm al-Walad is free even if the child is dead.

(٢١٧٨٧) حکم بن ابان فرماتے ہیں کہ حضرت عکرمہ سے امہات الاولاد کے بارے میں پوچھا گیا تو فرمایا : وہ آزاد ہیں، انھوں نے کہا : آپ کیوں یہ بات کہتے ہیں ؟ فرمایا : قرآن کی وجہ سے۔ انھوں نے کہا : قرآن میں کیا ہے ؟ انھوں نے کہا : { یٰٓأَیُّھَا الَّذِیْنَ اٰمَنُوْٓا اَطِیْعُوا اللّٰہَ وَ اَطِیْعُوا الرَّسُوْلَ وَ اُولِی الْاَمْرِ مِنْکُمْ } [النساء ٥٩] اللہ اور رسول کی اطاعت کرو اور حکمرانوں کی۔ حضرت عمر بھی اولوالامر میں سے تھے۔ فرماتے ہیں : وہ آزاد ہوگی اگرچہ بچہ مردہ بھی ہو۔ (ب) ابن عباس (رض) نبی (صلی اللہ علیہ وآلہ وسلم) سے نقل فرماتے ہیں کہ ام الولد آزاد ہے اگرچہ بچہ مردہ ہی کیوں نہ ہو۔

٢١٧٨٧ - وَأَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ أَبُو مَنْصُورٍ النَّضْرَوِيُّ، ثنا أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، ثنا سُفْيَانُ، حَدَّثَنِي الْحَكَمُ بْنُ أَبَانَ،قَالَ:سُئِلَ عِكْرِمَةُ عَنْ أُمَّهَاتِ الْأَوْلَادِ،قَالَ:" هُنَّ أَحْرَارٌ "،قَالُوا لَهُ:بِأِيِّ شَيْءٍ تَقُولُهُ؟قَالَ:" بِالْقُرْآنِ "،قَالُوا:بِمَاذَا مِنَ الْقُرْآنِ؟قَالَ:" قَوْلُ اللهِ تَعَالَى:{أَطِيعُوا اللهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الْأَمْرِ مِنْكُمْ}[النساء: ٥٩]وَكَانَ عُمَرُ رَضِيَ اللهُ عَنْهُ مِنْ أُولِي الْأَمْرِ،قَالَ:عَتَقَتْ وَإِنْ كَانَ سَقْطًا "
