Chapter: The defendant must take an oath

بَابُ الْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ، فِي الأَمْوَالِ وَالْحُدُودِ

Sahih al-Bukhari 2668

Ibn Abu Mulaika narrated that Ibn Abbas (رضي الله تعالى عنه) wrote that the Prophet ( صلى الله عليه وآله وسلم) gave his verdict on the basis of the defendant's oath.

حضرت ابن ابی ملیکہ ؓ سے روایت ہے، انھوں نے کہا: حضرت ابن عباس  ؓ نے مجھے خط لکھا کہ نبی کریم ﷺ نے فیصلہ فرمایا کہ قسم مدعی علیہ کے ذمے ہوگی۔

Hazrat Ibn Abi Mulayka (Radi Allahu Anhu) se riwayat hai, unhon ne kaha: Hazrat Ibn Abbas (Radi Allahu Anhu) ne mujhe khat likha ke Nabi Kareem (Sallallahu Alaihi Wasallam) ne faisla farmaya ke qasam mudda-alaih ke zimme hogi.

حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا نَافِعُ بْنُ عُمَرَ ، عَنِ ابْنِ أَبِي مُلَيْكَةَ ، قَالَ : كَتَبَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ عَلَى الْمُدَّعَى عَلَيْهِ .

Narrated Abu Wail: `Abdullah (bin Mas`ud) said, Whoever takes a (false) oath in order to grab some property (unjustly), Allah will be angry with him when he will meet Him. Allah confirmed that through His Divine Revelation: Verily! Those who purchase a little gain at the cost of Allah's covenant and their oaths . . . they will have a painful punishment. (3.77) Al-Ash'ath bin Qais came to us and asked, 'What is Abu `Abdur-Rahman (i.e. `Abdullah) telling you? 'We told him what he was narrating to us. He said, 'He was telling the truth; this Divine Verse was revealed in connection with me. There was a dispute between me and another man about something and the case was filed before Allah's Apostle who said, 'Produce your two witnesses or else the defendant is to take an oath.' I said, The defendant will surely take a (false) oath caring for nothing.' The Prophet said, 'Whoever takes a false oath in order to grab (other's) property, then Allah will be angry with him when he will meet Him.' Then Allah revealed its confirmation. Al-Ashath then recited the above Divine Verse. (3.77)

حضرت عبداللہ بن مسعود  ؓ سے روایت ہے، انھوں نے فرمایا: جو شخص کسی کامال ہتھیانے کے لیے جھوٹی قسم اٹھائے گا تو اللہ تعالیٰ سے اس حالت میں ملاقات کرے گا کہ وہ اس پر غضبناک ہوگا۔ پھر اللہ تعالیٰ نے اس کی تصدیق میں یہ آیت اتاری: ’’جو لوگ اللہ کے عہد اور اپنی قسموں کو۔ ۔ ۔ ان کے لیے المناک عذاب ہو گا۔‘‘ پھر اشعث بن قیس  ؓ ہمارے پاس تشریف لائے اور انھوں نے دریافت کیا کہ ابو عبدالرحمان  ؓ تمھیں کیا حدیث بیان کررہے تھے؟جو کچھ انھوں نے فرمایا تھا ہم نے انھیں بیان کیا۔ وہ فرمانے لگے: انھوں نے سچ فرمایا ہے۔ میرے باے میں ہی یہ آیت اتری تھی۔ ہوا یوں کہ میرے اور ایک (یہودی) آدمی کے درمیان کسی چیز کے متعلق جھگڑا تھا۔ ہم اس مقدمے کو رسول اللہ ﷺ کے پاس لے گئے تو آپ نے فرمایا: ’’تمہارے دو گواہ دعویٰ ثابت کریں گے یا وہ قسم ا ٹھائے گا۔‘‘ میں نے عرض کیا: یہ تو قسم اٹھا لے گا اور اس کی کوئی پروا نہیں کرے گا۔ یہ سن کر نبی کریم ﷺ نے فرمایا: ’’جو شخص جھوٹی قسم اٹھائے تاکہ اسکے ذریعے سے مال کا مستحق ہوجائے، حالانکہ وہ اس میں جھوٹا ہے تو وہ اللہ تعالیٰ سے اس حالت ملے گاکہ وہ اس پر غضبناک ہوگا۔‘‘ اللہ تعالیٰ نے اس کی تصدیق میں مذکورہ بالا آیت نازل فرمائی، پھر آپ نے اس آیت کی تلاوت فرمائی۔

Hazrat Abdullah bin Mas'ood (Radi Allahu Anhu) se riwayat hai, unhon ne farmaya: Jo shakhs kisi ka maal hathiyane ke liye jhooti qasam uthayega to Allah Ta'ala se is halat mein mulaqat karega ke woh is par ghazabnak hoga. Phir Allah Ta'ala ne is ki tasdeeq mein yeh aayat utari: ''Jo log Allah ke ahad aur apni qasmon ko... in ke liye alnaak azab hoga.'' Phir Ash'as bin Qais (Radi Allahu Anhu) hamare paas tashreef laye aur unhon ne daryaft kiya ke Abu Abdul Rahman (Radi Allahu Anhu) tumhein kya hadees bayan kar rahe thay? Jo kuch unhon ne farmaya tha hum ne unhein bayan kiya. Woh farmane lage: unhon ne sach farmaya hai. Mere bare mein hi yeh aayat utri thi. Hua yun ke mere aur ek (Yahudi) aadmi ke darmiyan kisi cheez ke mutaliq jhagda tha. Hum is muqadmay ko Rasulullah (Sallallahu Alaihi Wasallam) ke paas le gaye to Aap ne farmaya: ''Tumhare do gawah dawa sabit karenge ya woh qasam uthayega.'' Main ne arz kiya: yeh to qasam utha lega aur is ki koi parwah nahi karega. Yeh sun kar Nabi Kareem (Sallallahu Alaihi Wasallam) ne farmaya: ''Jo shakhs jhooti qasam uthaye taake is ke zariye se maal ka mustahiq ho jaye, halanke woh is mein jhoota hai to woh Allah Ta'ala se is halat mein milega ke woh is par ghazabnak hoga.'' Allah Ta'ala ne is ki tasdeeq mein mazkoora-bala aayat nazil farmayi, phir Aap ne is aayat ki tilawat farmayi.

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا جَرِيرٌ ، عَنْ مَنْصُورٍ ، عَنْ أَبِي وَائِلٍ ، قَالَ : قَالَ عَبْدُ اللَّهِ : مَنْ حَلَفَ عَلَى يَمِينٍ يَسْتَحِقُّ بِهَا مَالًا لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ ، ثُمَّ أَنْزَلَ اللَّهُ تَصْدِيقَ ذَلِكَ إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ إِلَى عَذَابٌ أَلِيمٌ سورة آل عمران آية 77 ، ثُمَّ إِنَّ الْأَشْعَثَ بْنَ قَيْسٍ خَرَجَ إِلَيْنَا ، فَقَالَ : مَا يُحَدِّثُكُمْ أَبُو عَبْدِ الرَّحْمَنِ ، فَحَدَّثْنَاهُ بِمَا قَالَ ، فَقَالَ : صَدَقَ ، لَفِيَّ أُنْزِلَتْ كَانَ بَيْنِي وَبَيْنَ رَجُلٍ خُصُومَةٌ فِي شَيْءٍ ، فَاخْتَصَمْنَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : شَاهِدَاكَ أَوْ يَمِينُهُ ؟ فَقُلْتُ لَهُ : إِنَّهُ إِذًا يَحْلِفُ وَلَا يُبَالِي ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : مَنْ حَلَفَ عَلَى يَمِينٍ يَسْتَحِقُّ بِهَا مَالًا وَهُوَ فِيهَا فَاجِرٌ ، لَقِيَ اللَّهَ عَزَّ وَجَلَّ وَهُوَ عَلَيْهِ غَضْبَانُ ، فَأَنْزَلَ اللَّهُ تَصْدِيقَ ذَلِكَ ، ثُمَّ اقْتَرَأَ هَذِهِ الْآيَةَ .

Rawi Abu Wail: Abdullah (bin Mas'ood) (Radi Allahu Anhu) ne kaha, jis kisi ne bhi nahaq maal hasil karne ke liye jhooti qasam uthayi, Allah us par ghusse hoga jab woh us se milega. Allah ne is ki tasdeeq apni wahyi ke zariye farmayi: ''Beshakk! Wo log jo Allah ke ahad aur apni qasmon ko thodi qeemat par bech dete hain... un ke liye dardnak azab hoga.'' (3:77) Al-Ash'as bin Qais hamare paas aaye aur poocha, 'Abu Abdur-Rahman (Abdullah bin Mas'ood Radi Allahu Anhu) tumhein kya bata rahe hain?' Hum ne unhein bataya jo woh bayan kar rahe thay. Unhon ne kaha, 'Unhon ne sach kaha; yeh aayat mere bare mein nazil hui thi. Mere aur ek doosre shakhs ke darmiyan kisi cheez par jhagda tha aur muqadma Allah ke Rasul (Sallallahu Alaihi Wasallam) ke paas pesh hua jinhon ne farmaya, 'Apne do gawah pesh karo warna mudda-alaih qasam uthayega.' Main ne kaha, 'Mudda-alaih to yaqeenan jhooti qasam utha lega aur kisi cheez ki parwah nahi karega.' Nabi (Sallallahu Alaihi Wasallam) ne farmaya, 'Jo koi bhi doosre ka maal hadap karne ke liye jhooti qasam uthayega, Allah us par sakht naraz hoga jab woh us se milega.' Phir Allah ne is ki tasdeeq nazil farmayi. Al-Ash'as ne phir mazkoora aayat parhi. (3:77)
