Chapter: "Those who take an oath, not to have sexual relations with their wives, must wait four months."

بَابُ قَوْلِ اللَّهِ تَعَالَى: {لِلَّذِينَ يُؤْلُونَ مِنْ نِسَائِهِمْ تَرَبُّصُ أَرْبَعَةِ أَشْهُرٍ} إِلَى قَوْلِهِ: {سَمِيعٌ عَلِيمٌ} {فَإِنْ فَاءُوا} رَجَعُوا
Sahih al-Bukhari 5291
Ibn Umar (رضئ هللا تعالی عنہ) added, ‘when the period of four months has expired, the husband should be put in prison so that he should divorce his wife, but the divorce does not occur unless the husband himself declares it. This has been mentioned by Uthman, Ali, Abu Ad-Darda (رضي الله تعالى عنهما), Ummul Momineen Aisha (رضي الله تعالى عنها) and twelve other companions of the Apostle (صلى الله عليه وآله وسلم).’
سیدنا ابن عمر ؓ ہی سے روایت ہے کہ جب چار ماہ گزر جائیں تو اسے قاضی کے سامنے پیش کیا جائے یہاں تک کہ وہ طلاق دے۔ اور طلاق اس وقت تک نہیں ہوگی جب تک وہ خود طلاق نہیں دے گا۔ سیدنا عثمان۔ سیدنا علی، سیدنا ابو درداء، سیدہ عائشہ اور دیکگر بارہ صحابہ کرام ؓ سے بھی ایسا ہی منقول ہے۔
Sayyidna Ibn Umar (radi Allahu anhu) hi se riwayat hai ke jab char mah guzar jayen to ise qazi ke samne pesh kiya jaye yahan tak ke woh talaq de. Aur talaq is waqt tak nahi hogi jab tak woh khud talaq nahi de ga. Sayyidna Usman, Sayyidna Ali, Sayyidna Abu Darda, Sayyida Aisha (radi Allahu anhum) aur digar barah sahaba karam (radi Allahu anhum) se bhi aisa hi manqool hai.
وَقَالَ لِي إِسْمَاعِيلُ حَدَّثَنِي مَالِكٌ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ إِذَا مَضَتْ أَرْبَعَةُ أَشْهُرٍ يُوقَفُ حَتَّى يُطَلِّقَ، وَلاَ يَقَعُ عَلَيْهِ الطَّلاَقُ حَتَّى يُطَلِّقَ. وَيُذْكَرُ ذَلِكَ عَنْ عُثْمَانَ وَعَلِيٍّ وَأَبِي الدَّرْدَاءِ وَعَائِشَةَ وَاثْنَيْ عَشَرَ رَجُلاً مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ.
