باب الْكَهَانَةِ

Narrated Ibn Shihab: Sa`id bin Al-Musayyab said, Allah's Apostle judged that in case of child killed in the womb of its mother, the offender should give the mother a slave or a female slave in recompense The offender said, How can I be fined for killing one who neither ate nor drank, neither spoke nor cried: a case like that should be denied ' On that Allah's Apostle said 'He is one of the brothers of the foretellers.
حضرت سعید بن مسیب سے روایت ہے کہ رسول اللہ ﷺ نے اس بچے کے متعلق جو ماں کے پیٹ میں مار ڈالا گیا ہو۔ فیصلہ فرمایا کہ ایک غلام یا لونڈی بطور دیت ادا کرنا ہے۔ جس نے تاوان ادا کرنا تھا اس نے کہا: میں ایسے بچے کی دیت کیوں ادا کروں جس نے نہ کھایا نہ پیا، نہ بولا اور نہ چلایا، ایسی صورت میں تو دیت نہیں ہو سکتی؟ رسول اللہ ﷺ نے یہ سن کر فرمایا: ”یہ تو کاہنوں کا بھائی ہے۔‘‘
Sayyiduna Saeed bin Musayyib se riwayat hai ke Rasool Allah (Sallallahu Alaihi Wa Sallam) ne is bache ke mutalliq jo maan ke pait mein maar dala gaya ho. faisla farmaya ke ek ghulam ya laundi bator-e-diyat ada karna hai. Jis ne tawan ada karna tha is ne kaha: mein aise bache ki diyat kyun ada karoon jis ne na khaya na piya, na bola aur na chalaya, aisi surat mein to diyat nahi ho sakti? Rasool Allah (Sallallahu Alaihi Wa Sallam) ne yeh sun kar farmaya: ‘yeh to kahino ka bhai hai.’
وَعَنْ ابْنِ شِهَابٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ : أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي الْجَنِينِ ، يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةٍ عَبْدٍ أَوْ وَلِيدَةٍ ، فَقَالَ الَّذِي قُضِيَ عَلَيْهِ : كَيْفَ أَغْرَمُ مَا لَا أَكَلَ ، وَلَا شَرِبَ ، وَلَا نَطَقَ ، وَلَا اسْتَهَلَّ ، وَمِثْلُ ذَلِكَ يُطَلُّ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ .
