Sahih al-Bukhari 6898
Sahl bin Abi Hathma (a man from the Ansar) narrated that a number of people from his tribe went to Khaibar and dispersed, and then they found one of them murdered. They said to the people with whom the corpse had been found, ‘you have killed our companion’. Those people said, ‘neither have we killed him, nor do we know his killer.’ The bereaved group went to the Prophet (صلى الله عليه وآله وسلم) and said, ‘O Allah's Apostle (صلى الله عليه وآله وسلم), we went to Khaibar and found one of us murdered.’ The Prophet (صلى الله عليه وآله وسلم) said, ‘let the older among you come forward and speak.’ Then the Prophet (صلى الله عليه وآله وسلم) said, to them, ‘bring your proof against the killer.’ They said ‘we have no proof.’ The Prophet ( صلى ہللا عليه و آلهوسلم) said, ‘then they (the defendants) will take an oath.’ They said, ‘we do not accept the oaths of the Jews.’ Allah's Apostle (صلى الله عليه وآله وسلم) did not like that the Blood-money of the killed one be lost without compensation, so he paid one-hundred camels out of the camels of Zakat (to the relatives of the deceased) as Diya (Blood-money).
حضرت بشیر بن یسار سے روایت ہے انہوں نے کہا: انصار کےایک صاحب حضرت سہل بن ابی ثمہ ؓ نے بتایا کہ ان کی قوم کے چند لوگ خیبر گئے اور وہاں انہوں نے اپنے میں سے ایک شخص کو مقتول پایا۔ جہاں مقتول ملا تھا وہاں کے لوگوں سے انہوں نے کہا: تم نے ہمارے ساتھی کو قتل کیا ہے۔ انہوں نے کہا: ہم نے قتل نہیں کیا اور نہ ہم قاتل ہی کو جانتے ہیں۔ پھر یہ لوگ رسول اللہ ﷺ کے پاس آئے اور کہا: اللہ کے رسول! ہم خیبر گئے تھے، وہاں ہم نے اپنے میں سے ایک مقتول کو پایا ہے۔ آپ ﷺ نے فرمایا: ”تم میں سے جو بڑا ہے وہ بات کرے۔“ نیز آپ نے فرمایا: ”تم اس پر گواہ پیش کرو جس نے قتل کیاہے۔“ انہوں نے کہا: ہمارے اس کے متعلق کوئی گواہ نہیں ہے۔ آپ ﷺ فرمایا: (”اگر تمہارے پاس گواہ نہیں) تو وہ (یہودی) قسم کھائیں گے۔“ انہوں نے کہا: ان (یہود) کی قسم پر ہمیں اعتماد نہیں، چنانچہ رسول اللہ ﷺ نے یہ پسند نہ فرمایا کہ مقتول کا خون رائیگاں جائے تو آپ نے صدقے کے اونٹوں میں سے اونٹ دیت میں دیے۔
Hazrat Bushair bin Yasar se riwayat hai unhone kaha: Ansar ke ek sahib Hazrat Sahl bin Abi Hathma (Radi Allahu Anhu) ne bataya ke in ki qawm ke chand log Khaibar gaye aur wahan unhone apne mein se ek shakhs ko maqtul paya. Jahan maqtul mila tha wahan ke logon se unhone kaha: Tum ne hamare sathi ko qatl kiya hai. Unhone kaha: Hum ne qatl nahi kiya aur na hum qatil hi ko jaante hain. Phir ye log Rasool Allah (Sallallahu Alaihi Wasallam) ke paas aaye aur kaha: Allah ke Rasool! Hum Khaibar gaye thay, wahan hum ne apne mein se ek maqtul ko paya hai. Aap (Sallallahu Alaihi Wasallam) ne farmaya: "Tum mein se jo bada hai wo baat kare." Neez Aap ne farmaya: "Tum is par gawah pesh karo jis ne qatl kiya hai." Unhone kaha: Hamare is ke mutaliq koi gawah nahi hai. Aap (Sallallahu Alaihi Wasallam) farmaya: ("Agar tumhare paas gawah nahi) to wo (Yahudi) qasam khaein ge." Unhone kaha: In (Yahud) ki qasam par humein aitimad nahi, chunanche Rasool Allah (Sallallahu Alaihi Wasallam) ne ye pasand na farmaya ke maqtul ka khoon raigan jaye to Aap ne sadqe ke oonton mein se oont diyat mein diye.
حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا سَعِيدُ بْنُ عُبَيْدٍ ، عَنْ بُشَيْرِ بْنِ يَسَارٍ ، زَعَمَ أَنَّ رَجُلًا مِنَ الْأَنْصَارِ يُقَالُ لَهُ : سَهْلُ بْنُ أَبِي حَثْمَةَ أَخْبَرَهُ : أَنَّ نَفَرًا مِنْ قَوْمِهِ انْطَلَقُوا إِلَى خَيْبَرَ ، فَتَفَرَّقُوا فِيهَا ، وَوَجَدُوا أَحَدَهُمْ قَتِيلًا ، وَقَالُوا لِلَّذِي وُجِدَ فِيهِمْ : قَدْ قَتَلْتُمْ صَاحِبَنَا ، قَالُوا : مَا قَتَلْنَا وَلَا عَلِمْنَا قَاتِلًا ، فَانْطَلَقُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالُوا : يَا رَسُولَ اللَّهِ انْطَلَقْنَا إِلَى خَيْبَرَ ، فَوَجَدْنَا أَحَدَنَا قَتِيلًا ، فَقَالَ : الْكُبْرَ الْكُبْرَ ، فَقَالَ : لَهُمْ تَأْتُونَ بِالْبَيِّنَةِ عَلَى مَنْ قَتَلَهُ ، قَالُوا : مَا لَنَا بَيِّنَةٌ ، قَالَ : فَيَحْلِفُونَ ، قَالُوا : لَا نَرْضَى بِأَيْمَانِ الْيَهُودِ ، فَكَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُبْطِلَ دَمَهُ فَوَدَاهُ مِائَةً مِنْ إِبِلِ الصَّدَقَةِ .
