Sahih al-Bukhari 6909
Abu Huraira (رضي الله تعالى عنه) narrated that Allah's Apostle (صلى الله عليه وآله وسلم) gave a verdict regarding an aborted fetus of a woman from Bani Lihyan that the killer (of the fetus) should give a male or female slave (as a Diya) but the woman who was required to give the slave, died, so Allah's Apostle (صلى الله عليه وآله وسلم) gave the verdict that her inheritance be given to her children and her husband, and the Diya be paid by her near relatives.
حضرت ابو ہریرہ ؓ سے روایت ہے کہ رسول اللہ ﷺ نے بنو لحیان کی ایک عورت کے بچے کے متعلق ایک غلام یا کنیز دینے کا فیصلہ کیا تھا۔ پھر وہ عورت جس کے خلاف آپ نے دیت دینے کا فیصلہ کیا تھا مرگئی تو رسول اللہ ﷺ نے فیصلہ فرمایا کہ اس کی وراثت اس کے بیٹوں اور اس کے شوہر کو ملے گی اور دیت کی ادائیگی ددھیال والوں کی کرنی ہوگی۔
Hazrat Abu Huraira (Radi Allahu Anhu) se riwayat hai ke Rasool Allah (Sallallahu Alaihi Wasallam) ne Banu Lihyan ki ek aurat ke bachay ke mutaliq ek ghulam ya kaneez dene ka faisla kiya tha. Phir wo aurat jis ke khilaf Aap ne diyat dene ka faisla kiya tha mar gayi to Rasool Allah (Sallallahu Alaihi Wasallam) ne faisla farmaya ke is ki wirasat is ke beton aur is ke shohar ko mile gi aur diyat ki adayigi dadiyal walon ki karni hogi.
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، حَدَّثَنَا اللَّيْثُ ، عَنِ ابْنِ شِهَابٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، عَنْ أَبِي هُرَيْرَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي جَنِينِ امْرَأَةٍ مِنْ بَنِي لَحْيَانَ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ ، ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قَضَى عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ مِيرَاثَهَا لِبَنِيهَا وَزَوْجِهَا وَأَنَّ الْعَقْلَ عَلَى عَصَبَتِهَا .
