Chapter on a woman who has been divorced three times: is she entitled to residence and maintenance?

باب في المطلقة ثلاثا ألها السكنى، والنفقة أم لا

Sunan al-Darimi 2311

Sayyida Fatimah bint Qais (may Allah be pleased with her) reported that her husband divorced her by uttering three pronouncements of divorce. The Prophet (peace and blessings of Allah be upon him) did not stipulate lodging or maintenance for her. Muslim said: I mentioned this to Ibrahim, whereupon he said: Sayyiduna 'Umar ibn al-Khattab (may Allah be pleased with him) said: Should we abandon the Book of our Lord and the Sunnah of His Messenger on account of the statement of a woman? No! Accordingly, he stipulated lodging and maintenance for the divorced woman.

سیدہ فاطمہ بنت قیس رضی اللہ عنہا سے روایت ہے کہ ان کے شوہر نے ان کو تین طلاق دیدی اور نبی کریم ﷺ نے ان کے لئے سکنی دلایا اور نہ نفقہ۔ مسلمہ نے کہا: میں نے اس کا تذکرہ ابراہیم سے کیا تو انہوں نے کہا: سیدنا عمر بن الخطاب رضی اللہ عنہ نے کہا: ہم اپنے رب کی کتاب اور اس کے رسول کی سنت کو ایک عورت کے کہنے سے چھوڑ دیں گے؟ نہیں، چنانچہ انہوں نے مطلقہ عورت کے لئے سکنی اور نفقہ مقرر فرمایا۔

Sada Fatima bint Qais raziallahu anha se riwayat hai ki un ke shohar ne un ko teen talaq dedi aur Nabi Kareem (صلى الله عليه وآله وسلم) ne un ke liye sukna dilaya aur na nafaqa. Muslimah ne kaha: mein ne is ka tazkirah Ibrahim se kiya to unhon ne kaha: Sayyiduna Umar bin al-Khattab raziallahu anhu ne kaha: hum apne Rab ki kitab aur us ke Rasool ki sunnat ko ek aurat ke kahne se chhor denge? Nahin, chunancha unhon ne mutallaqah aurat ke liye sukna aur nafaqa muqarrar farmaya.

أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ الشَّعْبِيِّ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ: "أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَفَقَةً وَلَا سُكْنَى". قَالَ سَلَمَةُ: فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ، فَقَالَ: قَالَ عُمَرُ بْنُ الْخَطَّابِ: لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّهِ بِقَوْلِ امْرَأَةٍ، فَجَعَلَ لَهَا السُّكْنَى وَالنَّفَقَةَ.

Sunan al-Darimi 2312

Sayyida Fatimah bint Qais (may Allah be pleased with her) narrated that when her husband divorced her with the third (and final) divorce, the Messenger of Allah (peace and blessings of Allah be upon him) ordered her to observe her waiting period ('iddah) in the house of her cousin, (Abdullah) ibn Umm Maktum.

سیدہ فاطمہ بنت قیس رضی اللہ عنہا نے حدیث بیان کی کہ ان کے شوہر نے ان کو تیسری طلاق دی تو رسول اللہ ﷺ نے انہیں حکم دیا کہ وہ اپنے چچا زاد بھائی (عبداللہ) بن ام مکتوم کے گھر میں عدت گذاریں۔

Sada Fatima bint Qais ( (رضي الله تعالى عنه) ا) ne hadees bayaan ki ke un ke شوہر ne un ko teesri talaq di to Rasul Allah (صلى الله عليه وآله وسلم) ne unhen hukm diya ke woh apne chacha zad bhai (Abdullah) bin Umm Maktum ke ghar mein iddat guzaren.

أَخْبَرَنَا يَعْلَى، حَدَّثَنَا زَكَرِيَّا، عَنْ عَامِرٍ، حَدَّثَتْنِي فَاطِمَةُ بِنْتُ قَيْسٍ:"أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا، فَأَمَرَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ تَعْتَدَّ عِنْدَ ابْنِ عَمِّهَا ابْنِ أُمِّ مَكْتُومٍ".

Sunan al-Darimi 2313

Sayyiduna Umar bin Al-Khattab, may Allah be pleased with him, said: "Should we abandon the Book of our Lord and the Sunnah of His Prophet because of the saying of a woman? No! For the woman who has been given three divorces, there is both lodging and financial support."


Grade: Sahih

سیدنا عمر بن الخطاب رضی اللہ عنہ نے کہا: ہم اپنے رب کی کتاب اور اس کے نبی کی سنت کو ایک عورت کے کہنے سے چھوڑ دیں گے؟ نہیں، جس عورت کی تین طلاق ہو جائے اس کے لئے سکنی بھی ہے اور نفقہ بھی۔

Sayyidna Umar bin al-Khattab (رضي الله تعالى عنه) ne kaha: Hum apne Rab ki kitaab aur uske Nabi ki sunnat ko ek aurat ke kehne se chhod denge? Nahin, jis aurat ki teen talaq ho jaye uske liye sukni bhi hai aur nafaqa bhi.

(حديث موقوف) أَخْبَرَنَا أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلَاءِ، حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ، عَنْ الْأَشْعَثِ، عَنْ الْحَكَمِ، وَحَمَّادٍ، عَنْ إِبْرَاهِيمَ، عَنْ الْأَسْوَدِ، عَنْ عُمَرَ، قَالَ: "لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّهِ بِقَوْلِ امْرَأَةٍ: الْمُطَلَّقَةُ ثَلَاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ".

Sunan al-Darimi 2314

It is narrated on the authority of Sayyiduna Umar (may Allah be pleased with him), as has been previously narrated.

سیدنا عمر رضی اللہ عنہ سے مثلِ سابق روایت ہے۔

Sayyidna Umar Radi Allah Anhu Se Misl E Sabiq Riwayat Hai

(حديث موقوف) أَخْبَرَنَا طَلْقُ بْنُ غَنَّامٍ، عَنْ حَفْصِ بْنِ غِيَاثٍ، عَنْ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ الْأَسْوَدِ، عَنْ عُمَرَ، نَحْوَهُ.

Sunan al-Darimi 2315

It is narrated on the authority of Aswad that the Commander of the Faithful, Sayyiduna Umar (may Allah be pleased with him) said: We will not listen to the word of any woman in the matter of Allah's Deen. A woman given three divorces is entitled to both lodging and maintenance. Imam Darimi (may Allah have mercy on him) said: In my opinion, such a divorcee is entitled to neither lodging nor maintenance.

اسود سے مروی ہے امیر المومنین سیدنا عمر رضی اللہ عنہ نے فرمایا: ہم اللہ کے دین میں کسی عورت کی بات نہیں مانیں گے۔ تین طلاق والی عورت کے لئے سکنی بھی ہے اور نفقہ بھی۔ امام دارمی رحمہ اللہ نے کہا: ایسی مطلقہ کے لئے میرے نزدیک نہ سکنی ہے اور نہ نفقہ۔

Aswad se marvi hai ameer ul momineen sayyiduna Umar razi Allah anhu ne farmaya: hum Allah ke deen mein kisi aurat ki baat nahin manenge. Teen talaq wali aurat ke liye sukni bhi hai aur nafaqa bhi. imam darmi rehmatullah alaih ne kaha: aisi mutlaqah ke liye mere nazdeek na sukni hai aur na nafaqa.

(حديث موقوف) أَخْبَرَنَا أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ، قَالَ: حَدَّثَنَا حَفْصٌ، عَنْ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ الْأَسْوَدِ، قَالَ: قَالَ عُمَرُ: "لَا نُجِيزُ قَوْلَ امْرَأَةٍ فِي دِينِ اللَّهِ: الْمُطَلَّقَةُ ثَلَاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ". قَالَ أَبُو مُحَمَّدٍ: لَا أَرَى السُّكْنَى وَالنَّفَقَةَ لِلْمُطَلَّقَةِ.
