Harith al-A'war narrated: A case concerning Banu 'Amr (paternal cousins) was presented before 'Abdullah bin Mas'ud (may Allah be pleased with him), one of whom was a maternal brother. He (Ibn Mas'ud) said: "All the wealth belongs to the maternal brother," as if he considered the maternal brother equivalent to a full brother for inheritance. When 'Ali (may Allah be pleased with him) arrived, I mentioned this case to him and informed him of Ibn Mas'ud's judgment. He said: "May Allah have mercy on him, he was indeed a knowledgeable scholar (faqih). However, I will not give more in this case than what Allah Almighty has ordained, which is one-sixth." The rest of the inheritance will then be divided among the remaining heirs according to their respective shares.

حارث الاعور نے کہا: سیدنا عبداللہ بن مسعود رضی اللہ عنہ کے پاس بنو عم (چچا زادوں کا) مسئلہ آیا جن میں سے ایک مادری بھائی تھا، انہوں نے کہا: سارا مال اخیافی (مادری) بھائی کا ہوگا، گویا انہوں نے مادری بھائی حساب کے یا حقیقی بھائی کے درجے میں رکھا، پھر جب سیدنا علی رضی اللہ عنہ تشریف لائے تو میں نے یہ مسئلہ ان کے سامنے پیش کیا اور سیدنا عبداللہ بن مسعود رضی اللہ عنہ کا فیصلہ انہیں بتایا تو انہوں نے کہا: اللہ ان پر رحم کرے وہ تو سمجھدار (فقیہ) تھے، لیکن میں جتنا اس صورت میں الله تعالیٰ نے فرض کیا ہے اس پر زیادہ نہ دوں گا، اس کے لئے سدس (چھاحصہ)، پھر ان میں سے ہی ایک آدمی کی طرح تقسیم ہوگی (تفصیل نیچے تشریح میں دیکھئے)۔
Haris Alaur ne kaha: Sayyidna Abdullah bin Masood (رضي الله تعالى عنه) ke pass Banu Amm (chacha zadon ka) masla aaya jin mein se ek madri bhai tha, unhon ne kaha: sara maal akhafi (madri) bhai ka hoga, goya unhon ne madri bhai hisab ke ya haqiqi bhai ke darje mein rakha, phir jab Sayyidna Ali (رضي الله تعالى عنه) tashreef laaye to maine ye masla unke samne pesh kiya aur Sayyidna Abdullah bin Masood (رضي الله تعالى عنه) ka faisla unhen bataya to unhon ne kaha: Allah un per reham kare wo to samajhdaar (faqih) the, lekin main jitna is surat mein Allah Ta'ala ne farz kiya hai is per ziada nah doon ga, iske liye suds (chhahisa), phir un mein se hi ek aadmi ki tarah taqsim hogi (tafseel neeche tashreeh mein dekhiye).
(حديث موقوف) أَخْبَرَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا زُهَيْرٌ، عَنْ أَبِي إِسْحَاق، عَنْ الْحَارِثِ الْأَعْوَرِ، قَالَ: أُتِيَ عَبْدُ اللَّهِ فِي فَرِيضَةِ بَنِي عَمٍّ، أَحَدُهُمْ أَخٌ لِأُمٍّ، فَقَالَ: الْمَالُ أَجْمَعُ لِأَخِيهِ لِأُمِّه، فَأَنْزَلَهُ بِحِسَابِ، أَوْ بِمَنْزِلَةِ الْأَخِ مِنْ الْأَبِ وَالْأُمِّ، فَلَمَّا قَدِمَ عَلِيٌّ، سَأَلْتُهُ عَنْهَا، وَأَخْبَرْتُهُ بِقَوْلِ عَبْدِ اللَّهِ، فَقَالَ:"يَرْحَمُهُ اللَّهُ، إِنْ كَانَ لَفَقِيهًا، أَمَّا أَنَا فَلَمْ أَكُنْ لِأَزِيدَهُ عَلَى مَا فَرَضَ اللَّهُ لَهُ: سَهْمٌ السُّدُسُ، ثُمَّ يُقَاسِمُهُمْ كَرَجُلٍ مِنْهُمْ".
