Chapter: Regarding a daughter and a sister.

باب: في ابنة وأخت

Sunan al-Darimi 2913

Aswad bin Yazid said: Sayyiduna Muadh bin Jabal, may Allah be pleased with him, gave a verdict in Yemen regarding a girl and her sister, and he gave half to the daughter and the remaining property (as a residue) to the sister.

اسود بن یزید نے کہا: سیدنا معاذ بن جبل رضی اللہ عنہ نے یمن میں لڑکی اور بہن کے بارے میں فیصلہ دیا اور بنت کو نصف اور باقی مال (عصبہ کے طور پر) بہن کو دیا۔

Aswad bin Yazid ne kaha: Sayyidna Muaz bin Jabal Radi Allahu anhu ne Yemen mein ladki aur behan ke bare mein faisla diya aur bint ko nisf aur baqi maal (asaba ke taur par) behan ko diya.

(حديث موقوف) أَخْبَرَنَا أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، عَنْ سُفْيَانَ الثَّوْرِيِّ، عَنْ أَشْعَثَ بْنِ أَبِي الشَّعْثَاءِ، عَنْ الْأَسْوَدِ بْنِ يَزِيدَ، قَالَ:"قَضَى مُعَاذُ بْنُ جَبَلٍ بِالْيَمَنِ فِي بِنْتٍ وَأُخْتٍ، فَأَعْطَى الْبِنْتَ النِّصْفَ، وَالْأُخْتَ النِّصْفَ".

Sunan al-Darimi 2914

It is narrated on the authority of Aswad bin Yazid that Abdullah bin Zubair, may Allah be pleased with him, would not give an inheritance share to a full sister with the daughter. Aswad then told him that Muadh bin Jabal, may Allah be pleased with him, had given half the share to the daughter and the rest to the full sister. Ibn Zubair, may Allah be pleased with him, then said: “You go to Abdullah bin Aqaba as my messenger.” At that time, Abdullah bin Aqaba was their judge in Kufa. So Aswad went to him and asked him about the solution to this issue.

اسود بن یزید سے مروی ہے کہ سیدنا عبداللہ ابن الزبیر رضی اللہ عنہ حقیقی بہن کو بیٹی کے ساتھ وراثت میں حصہ نہ دیتے تھے یہاں تک کہ اسود نے انہیں بتایا کہ سیدنا معاذ بن جبل رضی اللہ عنہ نے بیٹی کو نصف حصہ اور باقی حقیقی بہن کو دیا، سیدنا ابن زبیر رضی اللہ عنہ نے کہا: تم عبداللہ بن عقبہ کے پاس میرے قاصد کی حیثیت سے جاؤ، اس وقت عبداللہ بن عقبہ کوفہ میں ان کے قاضی تھے، چنانچہ اسود ان کے پاس گئے اور ان کو اس مسئلہ کا حل بتایا۔

Aswad bin Yazid se marvi hai ki Sayyiduna Abdullah ibn al-Zubayr razi Allah anhu haqiqi bahan ko beti ke sath warasat mein hissa nah dete the yahan tak ki Aswad ne unhen bataya ki Sayyiduna Muadh bin Jabal razi Allah anhu ne beti ko nisf hissa aur baqi haqiqi bahan ko diya, Sayyiduna Ibn Zubayr razi Allah anhu ne kaha: Tum Abdullah bin Aqabah ke paas mere qasid ki haisiyat se jao, is waqt Abdullah bin Aqabah Kufa mein un ke qazi the, chunancha Aswad un ke paas gaye aur un ko is masle ka hal bataya.

(حديث موقوف) أَخْبَرَنَا أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ الْأَسْوَدِ بْنِ يَزِيدَ: أَنَّ ابْنَ الزُّبَيْرِ كَانَ لَا يُوَرِّثُ الْأُخْتَ مِنْ الْأَبِ، وَالْأُمِّ مَعَ الْبِنْتِ حَتَّى حَدَّثَهُ الْأَسْوَدُ أَنَّ مُعَاذَ بْنَ جَبَلٍ جَعَلَ لِلْبِنْتِ النِّصْفَ، وَلِلْأُخْتِ النِّصْفَ"، فَقَالَ: أَنْتَ رَسُولِي إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَة، فَأَخْبِرْهُ بِذَاكَ، وَكَانَ قَاضِيَهُ بِالْكُوفَةِ.

Sunan al-Darimi 2915

Bishr ibn 'Umar said: I asked Ibn Abi'l-Zinad: A man died leaving a daughter and a sister, how would the inheritance be divided? He said: His daughter receives half, and what remains goes to the sister. He then added that my father, Kharijah ibn Zayd, reported that Sa'id ibn al-Musayyib attributed to Sayyiduna Zayd ibn Thabit (may Allah be pleased with him) that he used to make sisters ('asabah) along with daughters and give them from the inheritance what remained from the inheritors.

بشر بن عمر نے کہا: میں نے ابن ابی الزناد سے پوچھا: ایک آدمی نے ایک لڑکی اور ایک بہن چھوڑی، تقسیم کیسے ہوگی؟ انہوں نے کہا: اس کی بیٹی کو نصف اور جو بچے گا وہ بہن کو ملے گا، اور کہا کہ میرے والد خارجہ بن زید نے خبر دی کہ سیدنا زید بن ثابت رضی اللہ عنہ بہنوں کو بیٹیوں کے ساتھ عصبہ قرار دیتے تھے، اور ان کو وراثت میں سے وہی دیتے جو وارثین سے باقی بچتا۔

Bishr bin Umar ne kaha: main ne Ibn Abi al-Zinad se poocha: ek aadmi ne ek larki aur ek bahan chori, taqseem kaise hogi? Unhon ne kaha: us ki beti ko nisf aur jo bachega woh bahan ko milega, aur kaha ki mere walid Khaarija bin Zaid ne khabar di ki Sayyidna Zaid bin Thabit (رضي الله تعالى عنه) bahanon ko betiyon ke sath asaba qarar dete the, aur un ko wirasat mein se wohi dete jo warison se baqi bachta.

(حديث موقوف) حَدَّثَنَا حَدَّثَنَا بِشْرُ بْنُ عُمَرَ، قَالَ: سَأَلْتُ ابْنَ أَبِي الزِّنَادِ، عَنْ رَجُلٍ تَرَكَ بِنْتًا وَأُخْتًا؟ فَقَالَ:"لِابْنَتِهِ النِّصْف، وَلأُخْتِهِ مَا بَقِيَ"قَالَ: وَقَالَ: أَخْبَرَنِي أَبِي، عَنْ خَارِجَةَ بْنِ زَيْدٍ: أَنَّ زَيْدَ بْنَ ثَابِتٍ كَانَ "يَجْعَلُ الْأَخَوَاتِ مَعَ الْبَنَاتِ عَصَبَةً، لَا يَجْعَلُ لَهُنَّ إِلَّا مَا بَقِيَ".
