Chapter: Inheritance of relatives.

باب: في ميراث ذوي الأرحام

Sunan al-Darimi 3009

Asim bin 'Umar bin Qatadah Ansari reported that the Commander of the Faithful, Sayyiduna 'Umar bin Al-Khattab, may Allah be pleased with him, searched for an heir of Ibn Ad-Dahhak but did not find one, so he gave the wealth of Ibn Ad-Dahhak to his maternal uncles.

عاصم بن عمر بن قتادہ انصاری نے خبر دی کہ امیر المومنین سیدنا عمر بن الخطاب رضی اللہ عنہ نے ابن الدحداحہ کا وارث تلاش کیا جو انہیں ملا نہیں، چنانچہ انہوں نے ابن الدحداحہ کا مال ان کے ماموؤں کو دے دیا۔

Asim bin Umar bin Qatadah Ansari ne khabar di ke Ameer-ul-Momineen Sayyiduna Umar bin Al-Khattab (رضي الله تعالى عنه) ne Ibnud Dahdah ka waris talash kya jo unhen mila nahin, chunancha unhon ne Ibnud Dahdah ka maal un ke mamoo'n ko de diya.

(حديث موقوف) أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ يَزِيدَ، حَدَّثَنَا حَيْوَةُ، حَدَّثَنَا أَبُو الْأَسْوَدِ مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ نَوْفَلٍ: أَنَّ عَاصِمَ بْنَ عُمَرَ بْنِ قَتَادَةَ الْأَنْصَارِيَّ أَخْبَرَهُ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ"الْتَمَسَ مَنْ يَرِثُ ابْنَ الدَّحْدَاحَةِ، فَلَمْ يَجِدْ وَارِثًا، فَدَفَعَ مَالَ ابْنِ الدَّحْدَاحَةِ إِلَى أَخْوَالِ ابْنِ الدَّحْدَاحَةِ".

Sunan al-Darimi 3010

Sayyida Aisha, may Allah be pleased with her, said: "Allah and His Messenger are the guardians of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir."

سیدہ عائشہ رضی اللہ عنہا نے کہا: اللہ اور رسول اس کے والی ہیں جس کا کوئی والی نہ ہو اور ماموں اس کا وارث ہے جس کا کوئی وارث نہ ہو۔

Sayyida Ayesha ( (رضي الله تعالى عنه) ا) ne kaha: Allah aur Rasool uske wali hain jiska koi wali na ho aur mamun uska waris hai jiska koi waris na ho.

(حديث موقوف) أَخْبَرَنَا أَبُو عَاصِمٍ، عَنْ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ مُسْلِمٍ، عَنْ طَاوُسٍ، عَنْ عَائِشَةَ، قَالَتْ: "اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ، وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ".

Sunan al-Darimi 3011

Ziyad said that a case concerning the inheritance of a deceased person's maternal uncle and maternal aunt was presented before Umar ibn al-Khattab (may Allah be pleased with him). He (Umar) gave two-thirds of the inheritance to the maternal uncle and one-third to the maternal aunt.


Grade: Sahih

زیاد نے کہا سیدنا عمر رضی اللہ عنہ کے پاس ماں کے چچا اور خالہ کا قضیہ لایا گیا تو انہوں نے ماں کے چچا کو دو ثلث دیئے اور خالہ کو ایک ثلث دیا۔

Ziyad ne kaha Sayyidna Umar (رضي الله تعالى عنه) ke paas maan ke chacha aur khala ka qaziya laya gaya to unhon ne maan ke chacha ko do suls diye aur khala ko ek suls diya.

(حديث موقوف) أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ فِرَاسٍ، عَنْ الشَّعْبِيِّ، عَنْ زِيَادٍ، قَالَ:"أُتِيَ عُمَرُ فِي عَمٍّ لِأُمٍّ، وَخَالَة، فَأَعْطَى الْعَمَّ لِلْأُمِّ الثُّلُثَيْنِ، وَأَعْطَى الْخَالَةَ الثُّلُثَ".

Sunan al-Darimi 3012

It is narrated on the authority of Hasan (may Allah have mercy on him) that Sayyidina Umar bin Al-Khattab (may Allah be pleased with him) gave one-third (of the inheritance) to the maternal aunt and two-thirds to the paternal aunt.


Grade: Hasan

حسن رحمہ اللہ سے مروی ہے کہ سیدنا عمر بن الخطاب رضی اللہ عنہ نے خالہ کو ثلث اور پھوپھی کو دو ثلث دیا۔

Hasan rahmatullah alaih se marvi hai ke sayyidna Umar bin al khattab razi Allah anhu ne khala ko suls aur phoophi ko do suls diya.

(حديث موقوف) أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ يُونُسَ، عَنِ الْحَسَنِ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ "أَعْطَى الْخَالَةَ الثُّلُثَ، وَالْعَمَّةَ الثُّلُثَيْنِ".

Sunan al-Darimi 3013

Qays ibn Habtar Nahshali said: When the issue of (inheritance of) maternal aunt and paternal aunt was presented before Abd al-Malik ibn Marwan, an old man stood up and said: I was present with Umar ibn al-Khattab, may Allah be pleased with him, and he gave the maternal aunt one-third and the paternal aunt two-thirds. He intended to write it down then he said: Where would Zayd go from this?


Grade: Da'if

قیس بن حبتر نہشلی نے کہا: عبدالملک بن مروان کے پاس خالہ اور پھوپھی کا مسئلہ لایا گیا تو ایک شیخ کھڑے ہوئے اور انہوں نے کہا: میں سیدنا عمر بن الخطاب رضی اللہ عنہ کے پاس حاضر تھا، انہوں نے خالہ کو ثلث دیا اور پھوپھی کو دو ثلث (دو تہائی) دیا۔ اور انہوں نے اس کو لکھ دینے کا ارادہ کیا پھر کہا: ز ید اس سے کہاں جائیں گے؟

Qais bin Habtar Nahshali ne kaha: Abdulmalik bin Marwan ke paas khala aur phoophi ka masla laya gaya to ek sheikh kharay huye aur unhon ne kaha: main Sayyiduna Umar bin al-Khattab (رضي الله تعالى عنه) ke paas hazir tha, unhon ne khala ko sulus diya aur phoophi ko do sulus (do tihai) diya. Aur unhon ne is ko likh dene ka irada kiya phir kaha: Zaid is se kahan jayenge?.

(حديث موقوف) أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ الْحَسَنِ بْنِ عَمْرٍو، عَنْ غَالِبِ بْنِ عَبَّادٍ، عَنْ قَيْسِ بْنِ حَبْتَرٍ النَّهْشَلِيِّ، قَالَ: أُتِيَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ فِي خَالَةٍ وَعَمَّةٍ، فَقَامَ شَيْخٌ، فَقَالَ: شَهِدْتُ عُمَرَ بْنَ الْخَطَّابِ "أَعْطَى الْخَالَةَ الثُّلُثَ، وَالْعَمَّةَ الثُّلُثَيْنِ"، قَالَ: فَهَمَّ أَنْ يَكْتُبَ بِهِ، ثُمَّ قَالَ: أَيْنَ زَيْدٌ عَنْ هَذَا.

Sunan al-Darimi 3014

It is narrated on the authority of Masruq (may Allah have mercy on him): Sayyidina Abdullah ibn Mas'ud (may Allah be pleased with him) said: The maternal aunt is in the position of the mother, and the paternal aunt is in the position of the father, and the niece is in the position of the brother, and every relative by blood is in the position of the closest relative to the deceased when he has no closer heir.


Grade: Da'if

مسروق رحمہ اللہ سے مروی ہے: سیدنا عبداللہ بن مسعود رضی اللہ عنہ نے کہا: خالہ ماں کے درجے میں ہے، اور پھوپھی باپ کے درجے میں، اور بھتیجی بھائی کے درجہ میں، اور ہر ذی رحم (قرابت دار) اس درجہ میں ہے جو میت سے قریب کا رشتہ دار ہو جب کہ اس کا قریبی وارث نہ ہو۔

Masrooq rehmatullah alaih se marvi hai: Sayyiduna Abdullah bin Masood razi Allah anhu ne kaha: Khala maan ke darje mein hai, aur phuppi baap ke darje mein, aur bhatiji bhai ke darje mein, aur har zi rahm (qarabat daar) us darje mein hai jo mait se qareeb ka rishtedaar ho jab keh uska qareebi waris na ho.

(حديث موقوف) أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ مُحَمَّدِ بْنِ سَالِمٍ، عَنْ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللَّهِ قَالَ: "الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ، وَالْعَمَّةُ بِمَنْزِلَةِ الْأَبِ، وَبِنْتُ الْأَخِ بِمَنْزِلَةِ الْأَخِ، وَكُلُّ ذِي رَحِمٍ بِمَنْزِلَةِ رَحِمِهِ الَّتِي يُدْلِي بِهَا إِذَا لَمْ يَكُنْ وَارِثٌ ذُو قَرَابَةٍ".
