Chapter: The shares of Zoroastrians (non-Muslims) in inheritance.

باب: فرائض المجوس

Sunan al-Darimi 3120

Imam Zuhri (may Allah have mercy on him) said: When two lineages of Zoroastrians are combined, the elder one will be the inheritor.

Grade: Sahih

امام زہری رحمہ اللہ نے کہا: جب مجوس کے دو نسب ایک ساتھ جمع ہو جائیں تو جو بڑا ہو گا وہی وارث ہو گا۔

Imam Zuhri rahmatullah alaih ne kaha: Jab Majoos ke do nasab ek saath jama ho jayen to jo bada ho ga wohi waris ho ga.

(حديث مقطوع) أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا عَبْدُ الْأَعْلَى، عَنْ مَعْمَرٍ، عَنْ الزُّهْرِيِّ، قَالَ: "إِذَا اجْتَمَعَ نَسَبَانِ، وُرِّثَ بِأَكْبَرِهِمَا، يَعْنِي الْمَجُوسَ".

Sunan al-Darimi 3121

Hammad ibn Abi Sulayman said: "In two lineages, the one whose lineage is proven will inherit, and the one whose lineage is not proven will not inherit."

Grade: Sahih

حماد بن ابی سلیمان نے کہا: دو نسب میں جس جانب سے نسب صحیح ہو وہ وارث ہو گا، اور جو نسب صحیح نہ ہو وہ وارث نہ ہو گا۔

Hamad bin Abi Sulaiman ne kaha: do nasab mein jis janib se nasab sahih ho woh waris ho ga, aur jo nasab sahih na ho woh waris na ho ga.

(حديث موقوف) حَدَّثَنَا حَجَّاجُ بْنُ مِنْهَالٍ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنْ حَمَّادِ بْنِ أَبِي سُلَيْمَانَ، قَالَ: "يَرِثُ مِنْ الْجَانِبِ الَّذِي يَصْلُحُ، وَلَا يَرِثُ مِنْ الْجَانِبِ الَّذِي لَا يَصْلُحُ".

Sunan al-Darimi 3122

Imam Shabi, may Allah have mercy on him, said: Sayyiduna Ali and Sayyiduna Ibn Masud, may Allah be pleased with them both, said regarding the Zoroastrians (Majus), that when they convert to Islam, they will be heirs from both lineages (i.e., paternal and maternal).

Grade: Da'if

امام شعبی رحمہ اللہ نے کہا: سیدنا علی اور سیدنا ابن مسعو رضی اللہ عنہما نے مجوس کے بارے میں کہا کہ جب وہ مسلمان ہو جائیں تو وہ دونوں قرابتوں کی جانب سے وارث ہوں گے۔

Imam Shabi rehmatullahi alaih ne kaha: Sayidna Ali aur Sayidna Ibn Masud ( (رضي الله تعالى عنه) a ne Majus ke bare mein kaha ki jab woh Musalman ho jayen to woh dono qarabaton ki taraf se waris honge.

(حديث موقوف) حَدَّثَنَا حَجَّاجٌ، حَدَّثَنَا حَمَّادٌ، عَنْ سُفْيَانَ الثَّوْرِيِّ، عَنْ رَجُلٍ، عَنْ الشَّعْبِيِّ: أَنَّ عَلِيًّا، وَابْنَ مَسْعُودٍ، قَالَا فِي الْمَجُوسِ: "إِذَا أَسْلَمُوا، يَرِثُونَ مِنْ الْقَرَابَتَيْنِ جَمِيعًا".
