Chapter: Al-Wala' (loyalty and guardianship).
باب: الولاء
Sunan al-Darimi 3051
Jahm bin Dinar narrated from Ibrahim (may Allah have mercy on him) that he was asked: There are two sisters, one of whom bought her father and set him free. Then he (the father) passed away. Ibrahim (may Allah have mercy on him) said: "For both sisters, two-thirds, as the share is stipulated in the Holy Quran: *"For them (the parents) are two-thirds of what he leaves... "* [An-Nisa: 176/4] The remaining one-third will be for the daughter who set him free. Meaning, the other sister will not have any share in the remaining third, and the one who emancipated (the father) will take the entire third.

جہم بن دینار نے روایت کیا ابراہیم رحمہ اللہ سے مروی ہے کہ ان سے پوچھا گیا: دو بہنیں ہیں ان میں سے ایک نے اپنے والد کو خریدا اور آزاد کر دیا پھر ان (والد) کا انتقال ہو گیا، تو ابراہیم رحمہ اللہ نے کہا: دونوں بہنوں کے لئے دو ثلث جیسا کہ قرآن پاک میں حصہ مقرر ہے: «فَلَهُمَا الثُّلُثَانِ مِمَّا تَرَكَ . . . . . .» [النساء: 176/4] باقی جو بچا وہ صرف آزاد کرنے والی بیٹی کے لئے ہو گا۔ یعنی دوسری بہن کے لئے باقی حصہ ثلث میں سے کچھ نہ ہو گا اور پورا ثلث معتقہ لے لے گی۔

(حديث مقطوع) حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ، حَدَّثَنَا أَشْعَثُ، عَنْ جَهْمِ بْنِ دِينَارٍ، عَنْ إِبْرَاهِيمَ: أَنَّهُ"سُئِلَ عَنْ أُخْتَيْنِ اشْتَرَتْ إِحْدَاهُمَا أَبَاهَا فَأَعْتَقَتْهُ، ثُمَّ مَاتَ، قَالَ لَهُمَا: الثُّلُثَانِ فَرِيضَتُهُمَا فِي كِتَابِ اللَّهِ، وَمَا بَقِيَ فَلِلْمُعْتِقَةِ دُونَ الْأُخْرَى".
