Chapter: Al-Wala' (loyalty and guardianship).
باب: الولاء
Sunan al-Darimi 3052
Narrated from Ash'ath, Sha'bi (may Allah have mercy on him) reported that a woman emancipated her father. Then the father died and left behind four daughters, one of whom had emancipated him. Sha'bi (may Allah have mercy on him) said: The emancipating daughter has no preferential right; the inheritance will be divided into two-thirds among the four sisters, and the emancipator will be included among them.

اشعث سے مروی ہے شعبی رحمہ اللہ نے روایت کیا وہ عورت جس نے اپنے باپ کو آزاد کرایا پھر باپ کا انتقال ہو گیا اور اس نے چار بیٹیاں چھوڑیں جن میں سے ایک آزاد کرانے والی تھی، شعبی رحمہ اللہ نے کہا: آزاد کرانے والی کا کوئی احسان نہیں، چاروں بہنوں میں دو ثلث ہی تقسیم کیا جائے گا اور وہ معتقہ بھی ان میں شامل ہو گی۔
Ashas se marvi hai Shabi rehmatullah ne riwayat kiya woh aurat jisne apne baap ko azad karaya phir baap ka inteqal ho gaya aur usne chaar betiyan chhodin jin mein se ek azad karane wali thi, Shabi rehmatullah ne kaha: azad karane wali ka koi ehsaan nahin, chaaron bahnon mein do suls hi taqsim kiya jayega aur woh mutahida bhi un mein shamil ho gi.
(حديث مقطوع) حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا إِسْرَائِيلُ، حَدَّثَنَا الْأَشْعَثُ، عَنْ الشَّعْبِيِّ:"فِي امْرَأَةٍ أَعْتَقَتْ أَبَاهَا، فَمَاتَ الْأَبُ وَتَرَكَ أَرْبَعَ بَنَاتٍ هِيَ إِحْدَاهُنَّ، قَالَ: لَيْسَ عَلَيْهِ مِنَّةٌ، لَهُنَّ الثُّلُثَانِ، وَهِيَ مَعَهُنَّ".
