Chapter: Regarding claim and denial (dispute over inheritance).
باب: في الادعاء والإنكار
Sunan al-Darimi 3106
Ibrahim (peace be upon him) said: When two inheritors are truthful and bear witness to the debt, the debt will be paid from the total estate. Imam Shabi (peace be upon him) said: Only those two will pay the debt from their share.

ابراہیم رحمہ اللہ نے کہا: جب دو وارث جو سچے ہوں اور قرض کی گواہی دیں تو کل مال سے قرض ادا کیا جائے گا، امام شعبی رحمہ اللہ نے کہا: بس وہی دونوں اپنے حصہ سے قرض ادا کریں گے۔
Ibraheem rehmatullah alaih ne kaha: jab do waris jo sache hon aur qarz ki gawahi den to kul maal se qarz ada kiya jaye ga, Imam Shabi rehmatullah alaih ne kaha: bas wohi donon apne hissa se qarz ada karenge.
(حديث مقطوع) حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ أَبِي هَاشِمٍ، عَنْ إِبْرَاهِيمَ، قَالَ: "إِذَا شَهِدَ اثْنَانِ مِنْ الْوَرَثَةِ بِدَيْنٍ، فَهُوَ مِنْ جَمِيعِ الْمَالِ إِذَا كَانُوا عُدُولًا"، وَقَالَ الشَّعْبِيُّ: عَلَيْهِمَا فِي بَاب فِي مِيرَاثِ الْمُرْتَدِّ.
