Chapter: Inheritance of an illegitimate child.
باب: في ميراث ولد الزنا
Sunan al-Darimi 3147
Saeed said: Imam Zuhri, may Allah have mercy on him, was asked about a child born out of wedlock who dies. He said: "If he was from an Arab woman, then his mother inherits one-third and the rest of the wealth is to be given to the public treasury. And if he was the son of a slave woman, then his mother inherits one-third and what remains is inherited by the one who emancipated his slave mother." Marwan said: "I heard Imam Malik, may Allah have mercy on him, say the same."

سعید نے کہا: امام زہری رحمہ اللہ سے ولد الزنا کے بارے میں پوچھا گیا جو وفات پا جائے، کہا: اگر عربی عورت سے تھا تو اس کی ماں ثلث (تہائی) کی وارث ہو گی اور باقی مال بیت المال میں داخل کر دیا جائے گا، اور اگر وہ مرنے والا لونڈی کا لڑکا تھا تو بھی اس کی ماں ثلث کی وارث ہو گی اور جو باقی بچا اس کے لونڈی کو آزاد کرنے والے وارث ہوں گے۔ مروان نے کہا: میں نے سنا امام مالک رحمہ اللہ یہ ہی فرماتے تھے۔
Saeed ne kaha: Imam Zuhri rehmatullah alaih se walad-ul-zina ke baare mein poocha gaya jo wafat pa jaye, kaha: Agar Arabi aurat se tha to uski maan suls (tehai) ki waris ho gi aur baqi maal baitulmaal mein daakhil kar diya jayega, aur agar woh marne wala laundi ka ladka tha to bhi uski maan suls ki waris ho gi aur jo baqi bacha uske laundi ko azad karne wale waris honge. Marwan ne kaha: Maine suna Imam Malik rehmatullah alaih yahi farmate thay.
(حديث مقطوع) حَدَّثَنَا مَرْوَانُ بْنُ مُحَمَّدٍ، عَنْ سَعِيدٍ، عَنْ الزُّهْرِيِّ: سُئِلَ عَنْ وَلَدِ زِنَا يَمُوتُ، قَالَ: "إِنْ كَانَ ابْنَ عَرَبِيَّةٍ، وَرِثَتْ أُمُّهُ الثُّلُثَ، وَجُعِلَ بَقِيَّةُ مَالِهِ فِي بَيْتِ الْمَالِ، وَإِنْ كَانَ ابْنَ مَوْلَاةٍ، وَرِثَتْ أُمُّهُ الثُّلُثَ، وَوَرِثَ مَوَالِيهَا الَّذِينَ أَعْتَقُوهَا مَا بَقِيَ. قَالَ مَرْوَانُ: سَمِعْتُ مَالِكًا يَقُولُ ذَلِكَ.
