باب: ما للنساء من الولاء
Sunan al-Darimi 3175
`Abd al-Malik reported on the authority of `Ata': A man died leaving behind only one Mukatab slave (whose freedom had a price set) and he had sons and daughters. Will there be any share for the women from the inheritance of the slave? `Ata' said: There will be a share for the women from what is due on him (the slave) as per the Kitaba (contract of freeing), and the Wala' (right of inheritance) will only be for the men, not for the women except for what they had stipulated or set him free with.

عبدالملک نے بیان کیا، عطاء سے مروی ہے: ایسا آدمی جو مرنے کے بعد صرف ایک مکاتب غلام (جس کی آزادی کے لئے رقم مقرر ہو) چھوڑ گیا اور اس کے بیٹے بیٹیاں ہیں، کیا غلام کی میراث میں سے عورتوں کے لئے کچھ حصہ ہو گا؟ عطاء نے کہا: عورتوں کے لئے اس میں سے حصہ ہو گا جو رقم مکاتبے کے مطابق ابھی دینا باقی ہے، اور ولاء (حق وراثت) صرف مردوں کے لئے ہو گا، عورتوں کے لئے نہیں، سوائے اس رقم کے جو انہوں نے مقرر کی ہو یا آزاد کیا ہو۔
Abdulmalik ne bayan kya, Ata se marvi hai: Aisa aadmi jo marne ke baad sirf ek maktab gulam (jis ki azadi ke liye raqam muqarrar ho) chhor gya aur uske bete betiyan hain, kya gulam ki miraas mein se auraton ke liye kuch hissa hoga? Ata ne kaha: Auratoun ke liye us mein se hissa hoga jo raqam maktabe ke mutabiq abhi dena baqi hai, aur wilaya (haque wirasat) sirf mardon ke liye hoga, auraton ke liye nahin, siwaye us raqam ke jo unhon ne muqarrar ki ho ya azad kya ho.
(حديث مقطوع) حَدَّثَنَا يَعْلَى بْنُ عُبَيْدٍ، حَدَّثَنَا عَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ: فِي الرَّجُلِ يَمُوتُ وَيَتْرُكُ مُكَاتَبًا، وَلَهُ بَنُونَ وَبَنَاتٌ، أَيَكُونُ لِلنِّسَاءِ مِنْ الْوَلَاءِ شَيْءٌ؟ قَالَ: "تَرِثُ النِّسَاءُ مِمَّا عَلَى ظَهْرِهِ مِنْ مُكَاتَبَتِهِ، وَيَكُونُ الْوَلَاءُ لِلرِّجَالِ دُونَ النِّسَاءِ، إِلَّا مَا كَاتَبْنَ، أَوْ أَعْتَقْنَ".
