Chapter: Drawing lots for loyalty.
باب: جر الولاء
Sunan al-Darimi 3200
It is narrated on the authority of Imam Amr bin Shuaib, from his father, from his grandfather: A slave passed away, leaving behind his freed father and his son (i.e., the son of the deceased) from a free woman. To whom does the wala' (right of inheritance) belong? He (meaning, Amr bin Shuaib) said: In such a case, the wala' belongs to the former masters of the grandfather.

امام عامر شعبی رحمہ اللہ سے مروی ہے: ایک غلام مر گیا اور اس کا آزاد باپ اور اس کے بیٹے (یعنی مرنے والے کے بیٹے) آزاد عورت سے موجود ہیں تو ولاء کس کے لئے ہو گا؟ انہوں نے کہا: ایسی صورت میں دادا کے جو مالکان ہیں ولاء ان کا ہو گا۔
Imam Aamir Shabi rehmatullah alaih se marvi hai: Ek ghulam mar gaya aur us ka azad baap aur us ke bete (yani marne wale ke bete) azad aurat se maujood hain to wala kis ke liye ho ga? Unhon ne kaha: Aisi soorat mein dada ke jo malikan hain wala un ka ho ga.
(حديث مقطوع) حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا زَكَرِيَّا، عَنْ عَامِرٍ:"فِي مَمْلُوكٍ تُوُفِّيَ وَلَهُ أَبٌ حُرٌّ، وَلَهُ بَنُونَ مِنْ امْرَأَةٍ حُرَّةٍ، لِمَنْ وَلَاءُ وَلَدِهِ؟ قَالَ: لِمَوَالِي الْجَدِّ".
