Chapter on the right of preemption and similar issues
بَابُ الْعِينَةِ وَمَا يُشْبِهُهَا
Muwatta Imam Malik 1303
Yahya related to me from Malik that he had heard that a man wanted to buy food from a man in advance. The man who wanted to sell the food to him went with him to the market, and he began to show him heaps, saying, "Which one would you like me to buy for you." The buyer said to him, "Are you selling me what you do not have?" So they came to Abdullah ibn Umarand mentioned that to him. Abdallah ibn Umar said to the buyer, "Do not buy from him what he does not have." He said to the seller, "Do not sell what you do not have."
یحییٰ نے مجھے مالک سے روایت کی کہ انہوں نے سنا تھا کہ ایک آدمی ایک آدمی سے پہلے سے کھانا خریدنا چاہتا تھا۔ جس آدمی نے اسے کھانا بیچنا تھا وہ اس کے ساتھ بازار گیا، اور وہ اسے ڈھیر دکھانے لگا اور کہنے لگا: "تم چاہتے ہو کہ میں تمہارے لیے کون سا خریدوں۔" خریدار نے اس سے کہا: "کیا تم مجھے وہ بیچ رہے ہو جو تمہارے پاس نہیں ہے؟" چنانچہ وہ عبداللہ بن عمر کے پاس آئے اور انہیں یہ بتایا۔ عبداللہ بن عمر نے خریدار سے کہا: "اس سے وہ چیز نہ خریدو جو اس کے پاس نہیں ہے۔" انہوں نے بیچنے والے سے کہا: "وہ چیز مت بیچو جو تمہارے پاس نہیں ہے۔"
Yahya ne mujhe Malik se riwayat ki ke unhon ne suna tha ke ek aadmi ek aadmi se pehle se khana kharidna chahta tha. Jis aadmi ne use khana bechna tha wo uske sath bazaar gaya, aur wo use dher dikhane laga aur kehne laga: "Tum chahte ho ke mein tumhare liye kaun sa kharidoon." Kharidar ne us se kaha: "Kya tum mujhe wo bech rahe ho jo tumhare pass nahi hai?" Chunanche wo Abdullah bin Umar ke pass aaye aur unhen ye bataya. Abdullah bin Umar ne kharidar se kaha: "Is se wo cheez na khareedo jo iske pass nahi hai." Unhon ne bechne wale se kaha: "Wo cheez mat becho jo tumhare pass nahi hai."
وَحَدَّثَنِي عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ أَنَّ رَجُلًا أَرَادَ أَنْ يَبْتَاعَ طَعَامًا مِنْ رَجُلٍ إِلَى أَجَلٍ ، فَذَهَبَ بِهِ الرَّجُلُ الَّذِي يُرِيدُ أَنْ يَبِيعَهُ الطَّعَامَ إِلَى السُّوقِ ، فَجَعَلَ يُرِيهِ الصُّبَرَ وَيَقُولُ لَهُ : مِنْ أَيِّهَا تُحِبُّ أَنْ أَبْتَاعَ لَكَ ؟ فَقَالَ الْمُبْتَاعُ : أَتَبِيعُنِي مَا لَيْسَ عِنْدَكَ ؟ فَأَتَيَا عَبْدَ اللَّهِ بْنَ عُمَرَ فَذَكَرَا ذَلِكَ لَهُ ، فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ لِلْمُبْتَاعِ : « لَا تَبْتَعْ مِنْهُ مَا لَيْسَ عِنْدَهُ ، وَقَالَ لِلْبَائِعِ لَا تَبِعْ مَا لَيْسَ عِنْدَكَ »
