Chapter on the right of preemption and similar issues
بَابُ الْعِينَةِ وَمَا يُشْبِهُهَا
Muwatta Imam Malik 1302
Yahya related to me from Malik that he had heard that receipts were given to people in the time of Marwan ibn al-Hakam for the produce of the market at al-Jar. People bought and sold the receipts among themselves before they took delivery of the goods. Zayd Thabit and one of the Companions of the Messenger of Allah, may Allah bless him and grant him peace, went to Marwan ibn al-Hakam and said, "Marwan! Do you make usury halal?" He said, "I seek refuge with Allah! What is that?" He said, "These receipts which people buy and sell before they take delivery of the goods." Marwan therefore sent a guard to follow them and to take them from people's hands and return them to their owners.
یحییٰ نے مجھ سے مالک کی سند سے روایت کی کہ انہوں نے سنا تھا کہ مروان بن الحکم کے زمانے میں لوگوں کو الجر کی منڈی کی پیداوار کے عوض رسیدیں دی جاتی تھیں۔ لوگ مال کی ترسیل سے پہلے ہی آپس میں رسیدیں خریدتے اور بیچتے تھے۔ زید ثابت اور رسول اللہ صلی اللہ علیہ وسلم کے ایک صحابی رضی اللہ عنہ، مروان بن الحکم کے پاس گئے اور کہا: "مروان! کیا تم سود کو حلال کرتے ہو?" اس نے کہا: "میں اللہ کی پناہ میں آتا ہوں! یہ کیا ہے؟" انہوں نے کہا: "یہ وہ رسیدیں ہیں جنہیں لوگ مال کی ترسیل سے پہلے خریدتے اور بیچتے ہیں۔" چنانچہ مروان نے ان کے پیچھے ایک محافظ بھیجا تاکہ وہ لوگوں سے رسیدیں لے کر ان کے مالکان کو واپس کر دے۔
Yahiya ne mujh se Malik ki sanad se riwayat ki keh unhon ne suna tha keh Marwan bin Hakam ke zamane mein logon ko Al-Jar ki mandi ki paidaawar ke awaz raseedain di jati thin. Log maal ki tarseel se pehle hi aapas mein raseedain kharidte aur bechte thay. Zaid Sabit aur Rasul Allah sallallahu alaihi wasallam ke aik sahabi, razi Allah anhu, Marwan bin Hakam ke pass gaye aur kaha: "Marwan! Kya tum sood ko halal karte ho?" Usne kaha: "Mein Allah ki panah mein aata hun! Yeh kya hai?" Unhon ne kaha: "Yeh woh raseedain hain jinhen log maal ki tarseel se pehle kharidte aur bechte hain." Chunachih Marwan ne unke peechhe aik muhafiz bheja taake woh logon se raseedain lekar unke malikan ko wapis kar de.
وَحَدَّثَنِي عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ ، أَنَّ صُكُوكًا خَرَجَتْ لِلنَّاسِ فِي زَمَانِ مَرْوَانَ بْنِ الْحَكَمِ مِنْ طَعَامِ الْجَارِ ، فَتَبَايَعَ النَّاسُ تِلْكَ الصُّكُوكَ بَيْنَهُمْ قَبْلَ أَنْ يَسْتَوْفُوهَا ، فَدَخَلَ زَيْدُ بْنُ ثَابِتٍ ، وَرَجُلٌ مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ عَلَى مَرْوَانَ بْنِ الْحَكَمِ ، فَقَالَ : " أَتُحِلُّ بَيْعَ الرِّبَا يَا مَرْوَانُ ؟ فَقَالَ : أَعُوذُ بِاللَّهِ ، وَمَا ذَاكَ ؟ فقَالَ : هَذِهِ الصُّكُوكُ تَبَايَعَهَا النَّاسُ ، ثُمَّ بَاعُوهَا ، قَبْلَ أَنْ يَسْتَوْفُوهَا ، فَبَعَثَ مَرْوَانُ الْحَرَسَ يَتْبَعُونَهَا ، يَنْزِعُونَهَا مِنْ أَيْدِي النَّاسِ ، وَيَرُدُّونَهَا إِلَى أَهْلِهَا "
