Muwatta Imam Malik 1554
Yahya related to me from Malik from Ibn Shihab from Said ibn al- Musayyab that the Messenger of Allah, may Allah bless him and grant him peace, gave a judgement that the compensation for a foetus killed in its mother's womb was a slave or slave-girl of fair complexion and excellence. The one against whom the judgement was given said, "Why should I pay damages for that which did not drink or eat or speak or make any cry. The like of that is nothing." The Messenger of Allah, may Allah bless him and grant him peace, said, "This is only one of the brothers of the diviners." He disapproved of the rhyming speech of the man's declaration.
یحییٰ نے مجھ سے، مالک نے ابن شہاب سے، اور انہوں نے سعید بن المسیب سے روایت کی کہ رسول اللہ صلی اللہ علیہ وسلم نے فیصلہ صادر فرمایا کہ ماں کے پیٹ میں قتل کیے گئے جنین کا خون بہا ایک گورے، خوبصورت اور عمدہ غلام یا لونڈی ہے۔ جس شخص کے خلاف یہ فیصلہ دیا گیا تھا اس نے کہا، ''میں اس چیز کا خون بہا کیوں ادا کروں جس نے نہ پیا، نہ کھایا، نہ بولا اور نہ ہی کوئی رونا رویا۔ اس جیسی چیز تو کچھ بھی نہیں۔'' رسول اللہ صلی اللہ علیہ وسلم نے فرمایا، ''یہ تو کاہنوں کے بھائیوں میں سے ایک ہے۔'' آپ صلی اللہ علیہ وسلم نے اس شخص کی بات کے اسلوب اور قافیہ بندی کو ناپسند فرمایا۔
Yahya ne mujh se, Malik ne Ibn Shihab se, aur unhon ne Saeed bin Al-Musayyab se riwayat ki keh Rasul Allah sallallahu alaihi wasallam ne faisla sadar farmaya keh maan ke pet mein qatal kiye gaye janaen ka khoonbaha ek gorey, khoobsurat aur umdah ghulam ya laundi hai. Jis shakhs ke khilaf yeh faisla diya gaya tha us ne kaha, ''Main is cheez ka khoonbaha kyun ada karun jis ne na piya, na khaya, na bola aur na hi koi rona roya. Is jaisi cheez to kuchh bhi nahin.'' Rasul Allah sallallahu alaihi wasallam ne farmaya, ''Yeh to kahenon ke bhaiyon mein se ek hai.'' Aap sallallahu alaihi wasallam ne us shakhs ki baat ke usloob aur qafiyah bandi ko napasand farmaya.
وَحَدَّثَنِي عَنْ مَالِكٍ ، عَنِ ابْنِ شِهَابٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، « أَنَّ رَسُولَ اللَّهِ ﷺ قَضَى فِي الْجَنِينِ يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةٍ عَبْدٍ أَوْ وَلِيدَةٍ »، فَقَالَ الَّذِي قُضِيَ عَلَيْهِ : كَيْفَ أَغْرَمُ مَا لَا شَرِبَ ، وَلَا أَكَلْ ، وَلَا نَطَقَ ، وَلَا اسْتَهَلْ وَمِثْلُ ذَلِكَ بَطَلْ ، فَقَالَ رَسُولُ اللَّهِ ﷺ : « إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ »
