Chapter: Warning of the Fire for the one who swears a false oath in order to unlawfully take the right of another muslim

باب وَعِيدِ مَنِ اقْتَطَعَ حَقَّ مُسْلِمٍ بِيَمِينٍ فَاجِرَةٍ بِالنَّارِ
Sahih Muslim 138b
It is narrated on the authority of Abdullah (رضي الله تعالى عنه) that he heard the Prophet (صلى الله عليه وآله وسلم) saying : He who took an oath in order to entitle himself (to the possession) of a property, whereas he is a liar, would meet Allah (جَلَّ ذُو) in a state that He would be very much angry with him. Then the remaining part of the Hadith was narrated as transmitted by A'mash but with the exception of these words : There was a dispute between me and another person in regard to a well. We referred this dispute to the Apostle of Allah (صلى الله عليه وآله وسلم). Upon this he remarked : Either (you should produce) two witnesses (to support your contention) or his oath (would be accepted as valid).
حضرت عبداللہ ؓ سے روایت ہے انھوں نے کہا: ”جو شخص ایسی جھوٹی قسم اٹھاتا ہے جس کی بنا پر وہ مال کا حق دار ٹھہراتا ہے، وہ اللہ کو اس حال میں ملے گا کہ وہ اس پر غضب ناک ہو گا۔“ پھر اعمشؒ کی طرح روایت بیان کی، فرق یہ ہے کہ اس نے کہا: میرے اور ایک آدمی کے درمیان کنویں کے بارے میں جھگڑا تھا، تو ہم جھگڑا رسول اللہ صلی اللہ علیہ وسلم کے پاس لے گئے، تو آپؐ نے فرمایا: ”فیصلہ تیرے گواہوں یا اس کی قسم پر ہو گا۔“
Hazrat Abdullah (Radi Allahu Anhu) se riwayat hai unhon ne kaha: "Jo shakhs aisi jhooti qasam uthata hai jis ki bina par woh maal ka haqq-dar thehrata hai, woh Allah ko is haal mein milega ke woh is par ghazab-nak hoga." Phir A'mash ki tarah riwayat bayan ki, farq yeh hai ke is ne kaha: mere aur ek aadmi ke darmiyan kunwein ke baare mein jhagra tha, to hum jhagra Rasul Allah (Sallallahu Alaihi Wa Sallam) ke paas le gaye, to Aap (Sallallahu Alaihi Wa Sallam) ne farmaya: "Faisla tere gawahon ya is ki qasam par hoga."
حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أَخْبَرَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ أَبِي وَائِلٍ، عَنْ عَبْدِ اللَّهِ، قَالَ مَنْ حَلَفَ عَلَى يَمِينٍ يَسْتَحِقُّ بِهَا مَالاً هُوَ فِيهَا فَاجِرٌ لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ . ثُمَّ ذَكَرَ نَحْوَ حَدِيثِ الأَعْمَشِ غَيْرَ أَنَّهُ قَالَ كَانَتْ بَيْنِي وَبَيْنَ رَجُلٍ خُصُومَةٌ فِي بِئْرٍ فَاخْتَصَمْنَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " شَاهِدَاكَ أَوْ يَمِينُهُ " .
