Sahih Muslim 1421a
Ibn 'Abbas (Allah be pleased with him) reported Allah's Apostle (ﷺ) as saying:A woman without a husband has more right to her person than her guardian, and a virgin's consent must be asked from her, and her silence implies her consent.
حضرت ابن عباس رضی اللہ تعالیٰ عنہ بیان کرتے ہیں، رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”شوہر دیدہ عورت کا اپنے نفس کے بارے میں اپنے ولی، سر پرست، سے زیادہ حق ہے، اور کنواری کا باپ، اس کے نفس (نکاح) کے بارے میں اس سے اجازت حاصل کرے، اور اس کی اجازت، اس کی خاموشی ہے؟“ امام مالک رحمۃ اللہ علیہ نے اس بات کی تصدیق کی کہ میں نے یہ روایت سنی ہے۔
Hazrat Ibn Abbas (Radi Allahu Anhu) bayan karte hain, Rasool Allah (Sallallahu Alaihi Wasallam) ne farmaya: “Shauhar deeda aurat ka apne nafs ke bare mein apne wali, sar parast, se zyada haq hai, aur kunwari ka baap, uske nafs (nikaah) ke bare mein us se ijazat haasil kare, aur uski ijazat, uski khamoshi hai?” Imam Malik (Rehmatullah Alaih) ne is baat ki tasdeeq ki ki maine yeh riwayat suni hai.
حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ، وَقُتَيْبَةُ بْنُ سَعِيدٍ، قَالاَ حَدَّثَنَا مَالِكٌ، ح وَحَدَّثَنَا يَحْيَى، بْنُ يَحْيَى - وَاللَّفْظُ لَهُ - قَالَ قُلْتُ لِمَالِكٍ حَدَّثَكَ عَبْدُ اللَّهِ بْنُ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ " الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا " . قَالَ نَعَمْ .
