Chapter: Seeking permission of a previously-married woman in words, and of a virgin by silence

باب اسْتِئْذَانِ الثَّيِّبِ فِي النِّكَاحِ بِالنُّطْقِ وَالْبِكْرِ بِالسُّكُوتِ
Sahih Muslim 1421c
Sufyan reported on the basis of the same chain of transmitters (and the words are), ‘a woman who has been previously married ( ُالثَّي ِب) has more right to her person than her guardian; and a virgin's father must ask her consent; her consent being her silence. He said, at times, her silence is her affirmation.
امام صاحب ایک اور استاد کی سند سے مذکورہ بالا روایت میں کہ ”شوہر دیدہ اپنے ولی کے اعتبار سے اپنے نفس کی زیادہ حقدار ہے، اور اس کی اجازت، اس کی خاموشی ہے۔“ اور بسا اوقات آپ صلی اللہ علیہ وسلم نے فرمایا: ”اس کا سکوت ہی اس کا اقرار ہے۔“
Imam Sahab ek aur ustaad ki sanad se mazkoora bala riwayat mein ki “Shauhar deeda apne wali ke aitebar se apne nafs ki zyada haqdar hai, aur uski ijazat, uski khamoshi hai.” Aur basa auqaat aap (Sallallahu Alaihi Wasallam) ne farmaya: “Uska sukoot hi uska iqraar hai.”
وَحَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ، بِهَذَا الإِسْنَادِ وَقَالَ " الثَّيِّبُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ يَسْتَأْذِنُهَا أَبُوهَا فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا " . وَرُبَّمَا قَالَ " وَصَمْتُهَا إِقْرَارُهَا " .
