Chapter: The prohibition of divorcing a menstruating woman without her consent; If a man breaks this rule, it still counts as a divorce, and he should be ordered to take her back

باب تَحْرِيمِ طَلاَقِ الْحَائِضِ بِغَيْرِ رِضَاهَا وَأَنَّهُ لَوْ خَالَفَ وَقَعَ الطَّلاَقُ وَيُؤْمَرُ بِجْعَتِهَا

Sahih Muslim 1471k

A Hadith like this has been transmitted on the authority of Ayyub with a slight variation of words.

امام صاحب یہی روایت اپنے دو اساتذہ سے بیان کرتے ہیں، مگر اس میں یہ ہے کہ عمر رضی اللہ تعالیٰ عنہ نے نبی اکرم صلی اللہ علیہ وسلم سے دریافت کیا، تو آپ صلی اللہ علیہ وسلم نے اسے حکم دیا۔

Imam Sahab yehi riwayat apne do asatizah se bayan karte hain, magar is mein yeh hai ke Umar (Razi Allahu Anhu) ne Nabi Akram (Sallallahu Alaihi Wa Sallam) se daryaft kiya, to aap (Sallallahu Alaihi Wa Sallam) ne use hukum diya.

وَحَدَّثَنَاهُ أَبُو الرَّبِيعِ، وَقُتَيْبَةُ، قَالاَ حَدَّثَنَا حَمَّادٌ، عَنْ أَيُّوبَ، بِهَذَا الإِسْنَادِ ‏.‏ نَحْوَهُ غَيْرَ أَنَّهُ قَالَ فَسَأَلَ عُمَرُ النَّبِيَّ صلى الله عليه وسلم فَأَمَرَهُ ‏.‏
