Sahih Muslim 1616a
Jabir bin Abdullah (رضي الله تعالى عنه) reported, ‘I fell sick and there came to me on foot Allah's Apostle (صلى الله عليه وآله وسلم) and Abu Bakr (رضي الله تعالى عنه) for inquiring about my health. I fainted. The Prophet (صلى الله عليه وآله وسلم) performed ablution and then sprinkled over me the water of his ablution. I felt some relief and said, Allah's Apostle (صلى الله عليه وآله وسلم), how should I decide about my property? He said nothing to me in response until this verse pertaining to the law of inheritance was revealed - َ لَهُ وَلَدٌ وَلَهُ أُخْتٌ فَلَهَاَ لَةِ ۚ إِنِ امْرُؤٌ هَلَكَ لَيْسَّ ُ يُفْتِيكُمْ فِي الْكَاليَسْتَفْتُونَكَ قُلِ َّللا َِ ثُهَا إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ ۚ فَإِنْ كَكَ ۚ وَهُوَ يَرُ مَا تَرنِصْف ُِ مِثْلً وَ نِسَاءً فَلِلذَّكَرِ جَاالَكَ ۚ وَإِنْ كَانُوا إِخْوَ ةً رانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ مِمَّا تَر ٌَّ ُ بِكُل ِ شَيْءٍ عَلِيمِ لُّوا ۗ وََّللاَّ ُ لَكُمْ أَنْ تَضْ ُنْثَيَيْنِ ۗ يُبَي ِنُ َّللاحَظ ِ األ [They ask you (O' Prophet ﷺ) about Kalalah (a man who dies childless). Say, Allah has given a decision in the matter of inheritance. If a man dies and leaves no child behind but have a sister, she will get half of what he owned, as he would have done the whole of what she possessed if she had died childless. In case he has two sisters then they will get two-thirds of the heritage. But if he has both brothers and sisters, the male will inherit a share equal to that of two females. Allah makes this manifest to you, lest you wander astray, for Allah has knowledge of all the things.] (An-Nisa - 176).
حضرت جابر بن عبداللہ رضی اللہ تعالی عنہما بیان کرتے ہیں کہ میں بیمار پڑ گیا، تو رسول اللہ صلی اللہ علیہ وسلم اور ابوبکر پیدل چل کر میری بیمار پرسی کے لیے تشریف لائے، تو مجھ پر غشی طاری ہو گئی، اس پر رسول اللہ صلی اللہ علیہ وسلم نے وضو کیا، پھر اپنے وضو کا پانی مجھ پر ڈالا، تو مجھے ہوش آ گیا، میں نے کہا، اے اللہ کے رسول! میں اپنے مال کے بارے میں کیا فیصلہ کروں، کیسے تقسیم کروں، تو آپ صلی اللہ علیہ وسلم نے مجھے کوئی جواب نہیں دیا، حتی کہ وراثت کی آیت اتری، ”وہ آپ صلی اللہ علیہ وسلم سے فتویٰ پوچھتے ہیں، آپ فرمادیجئے، اللہ تعالیٰ تمہیں کلالہ کے بارے میں جواب دیتا ہے۔“
Hazrat Jabir Bin Abdullah (Razi Allahu Ta'ala Anhuma) bayan karte hain ki main bimar pad gaya, to Rasool Allah (Sallallahu Alaihi Wa Sallam) aur Abu Bakr (Razi Allahu Ta'ala Anhu) paidal chal kar meri bimar pursi ke liye tashreef laye, to mujh par ghashi taari ho gai, is par Rasool Allah (Sallallahu Alaihi Wa Sallam) ne wazu kiya, phir apne wazu ka pani mujh par dala, to mujhe hosh aa gaya, maine kaha, aye Allah ke Rasool! Main apne maal ke bare mein kya faisla karoon, kaise taqseem karoon, to Aap (Sallallahu Alaihi Wa Sallam) ne mujhe koi jawab nahi diya, hatta ki wirasat ki ayat utri, “Woh Aap (Sallallahu Alaihi Wa Sallam) se fatwa poochhte hain, aap farma dijiye, Allah Ta'ala tumhein Kalalah ke bare mein jawab deta hai.”
حَدَّثَنَا عَمْرُو بْنُ مُحَمَّدِ بْنِ بُكَيْرٍ النَّاقِدُ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ مُحَمَّدِ بْنِ، الْمُنْكَدِرِ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ، قَالَ مَرِضْتُ فَأَتَانِي رَسُولُ اللَّهِ صلى الله عليه وسلم وَأَبُو بَكْرٍ يَعُودَانِي مَاشِيَيْنِ فَأُغْمِيَ عَلَىَّ فَتَوَضَّأَ ثُمَّ صَبَّ عَلَىَّ مِنْ وَضُوئِهِ فَأَفَقْتُ قُلْتُ يَا رَسُولَ اللَّهِ كَيْفَ أَقْضِي فِي مَالِي فَلَمْ يَرُدَّ عَلَىَّ شَيْئًا حَتَّى نَزَلَتْ آيَةُ الْمِيرَاثِ { يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلاَلَةِ}
