Mustadrak Al Hakim 7057
Abdullah bin Umar (may Allah be pleased with him) narrated that the Prophet (peace and blessings of Allah be upon him) rejected the oath of the one who demanded his right (because he was a claimant, and the claimant is not to be asked to take an oath, rather it is upon him to present witnesses). ** This Hadith has a Sahih (authentic) chain of narrators, but Imam Bukhari (may Allah have mercy upon him) and Imam Muslim (may Allah have mercy upon him) did not narrate it.
" حضرت عبداللہ بن عمر رضی اللہ عنہما فرماتے ہیں کہ نبی اکرم ﷺ نے حق کا مطالبہ کرنے والے کی قسم کو رد کر دیا ( کیونکہ وہ مدعی تھا اور مدعی سے قسم نہیں لی جاتی بلکہ اس کے ذمے گواہ پیش کرنا ہوتا ہے ) ٭٭ یہ حدیث صحیح الاسناد ہے لیکن امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ نے اس کو نقل نہیں کیا ۔"
Hazrat Abdullah bin Umar ( (رضي الله تعالى عنه) a farmate hain ke Nabi Akram (صلى الله عليه وآله وسلم) ne haq ka mutalba karne wale ki qasam ko rad kar diya (kyunke wo muddai tha aur muddai se qasam nahi li jati balke uske zimme gawah pesh karna hota hai) ** Ye hadees sahih al-isnad hai lekin Imam Bukhari Rahmatullah Alaih aur Imam Muslim Rahmatullah Alaih ne isko naqal nahi kiya.
أَخْبَرَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ مَسْلَمَةَ الْعَنَزِيُّ، ثَنَا عُثْمَانُ بْنُ سَعِيدٍ الدَّارِمِيُّ، ثَنَا سُلَيْمَانُ بْنُ عَبْدِ الرَّحْمَنِ الدِّمَشْقِيُّ، ثَنَا مُحَمَّدُ بْنُ مَسْرُوقٍ، عَنْ إِسْحَاقَ بْنِ الْفُرَاتِ، عَنْ لَيْثِ بْنِ سَعْدٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، رَضِيَ اللَّهُ عَنْهُمَا قَالَ: «إِنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ رَدَّ الْيَمِينَ عَلَى طَالِبِ الْحَقِّ» هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ "" [التعليق - من تلخيص الذهبي] 7057 - لا أعرف محمدا وأخشى أن لا يكون الحديث باطلا
