Mustadrak Al Hakim 7955
Zaid bin Thabit (may Allah be pleased with him) narrates that when a man or a woman dies and leaves behind a girl as an heir, she will be given half of the total wealth. If there are two or more girls, they will be given two-thirds. And if there is a boy with them, then there is no fixed share for any of them. Then, if among his heirs there is a 'dhawi-al-furudh' (those whose shares are fixed, for details see our book "Rafeeq-ul-Warasat Sharah Siraji" published by Shabir Brothers, Lahore), then he will be given his share and the remaining will be distributed among all the children in such a way that the boys will get twice as much as the girls. ** This hadith is sahih (authentic) according to the criteria of Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him), but the two Sheikhs (may Allah have mercy on them) did not narrate it.
" حضرت زید بن ثابت رضی اللہ عنہ فرماتے ہیں کہ جب کوئی مرد یا عورت فوت ہو جائے اور ایک لڑکی وارث چھوڑے ، اس کو کل مال کا نصف دیا جائے گا ، اگر دو یا دو سے زیادہ ہوں تو دو ثلث دیا جائے ۔ اور اگر ان کے ہمراہ کوئی لڑکا ہو ، تو ان میں سے کسی کے لیے بھی مقرر حصہ نہیں ہے ، پھر اگر اس کے ورثاء میں کوئی ذوی الفروض ( جن کے حصے مقرر ہیں ، تفصیل ہماری کتاب رفیق الوارثت شرح سراجی مطبوعہ شبیر برادرز لاہور میں ملاحظہ فرمائیں ) ہو تو اس کو اس کا حصہ دے دیا جائے گا اور جو باقی بچے گا وہ تمام اولاد میں اس طرح تقسیم کیا جائے گا کہ لڑکوں کو لڑکیوں سے دگنا ملے ۔ ٭٭ یہ حدیث امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ کے معیار کے مطابق صحیح ہے لیکن شیخین رحمۃ اللہ علیہما نے اس کو نقل نہیں کیا ۔"
Hazrat Zaid bin Sabit (رضي الله تعالى عنه) farmate hain ki jab koi mard ya aurat foot ho jaye aur ek ladki waris chhore, us ko kul maal ka nisf diya jaye ga, agar do ya do se ziada hon to do suloos diya jaye. Aur agar un ke hamrah koi ladka ho, to un mein se kisi ke liye bhi muqarrar hissa nahi hai, phir agar us ke warisahon mein koi zavi alfaruz (jin ke hisse muqarrar hain, tafseel hamari kitab Rafeeq alWarasat sharah Siraji matbua Shabbir brothers Lahore mein mulahiza farmaen) ho to us ko us ka hissa de diya jaye ga aur jo baqi bache ga woh tamam aulad mein is tarah taqseem kiya jaye ga ki ladkon ko ladkiyon se dugna mile. ** Yeh hadees Imam Bukhari Rahmatullah Alaih aur Imam Muslim Rahmatullah Alaih ke miyaar ke mutabiq sahih hai lekin Sheikhein Rahmatullah Alaihema ne is ko naqal nahi kiya.
حَدَّثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثَنَا بَحْرُ بْنُ نَصْرِ بْنِ سَابِقٍ الْخَوْلَانِيُّ، ثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ، أَخْبَرَنِي ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ، عَنْ أَبِيهِ، قَالَ: "" إِذَا تُوُفِّيَ الرَّجُلُ أَوِ الْمَرْأَةُ وَتَرَكَ ابْنَةً وَاحِدَةً كَانَ لَهَا النِّصْفُ، فَإِنْ كَانَتَا اثْنَتَيْنِ فَمَا فَوْقَ ذَلِكَ كَانَ لَهُنَّ الثُّلُثَانِ، وَإِنْ كَانَ مَعَهُنَّ ذَكَرٌ فَلَا فَرِيضَةَ لِأَحَدٍ مِنْهُمْ وَيُبْدَأُ بِأَحَدٍ أَنْ يَشْرَكْهُنَّ بِفَرِيضَةٍ فَيُعْطَى فَرِيضَتَهُ فَمَا بَقِيَ بَعْدَ ذَلِكَ فَهُوَ لِلْوَلَدِ بَيْنَهُمْ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء: 11] فَإِنْ كَانَتَا اثْنَتَيْنِ فَمَا فَوْقَ ذَلِكَ مِنَ الْإِنَاثِ كَانَ لَهُنَّ الثُّلُثَانِ «هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ» قَالَ الْحَاكِمُ: «أَقَاوِيلُ زَيْدِ بْنِ ثَابِتٍ حَجَّةٌ عِنْدَ كَافَّةِ الصَّحَابَةِ» [التعليق - من تلخيص الذهبي] 7955 - على شرط البخاري ومسلم
