Mustadrak Al Hakim 7972
Zubair (may Allah be pleased with him) used to give this verdict concerning (the inheritance of) a daughter and a sister, that all the property should be given to the daughter. I said: Muadh (may Allah be pleased with him) had given this verdict amongst us in Yemen that half the property should be given to the daughter and half to the sister. Abdullah bin Zubair (may Allah be pleased with him) said: You go to Walid bin Utbah as my messenger (he was the judge of Kufa in those days). Tell him to act upon the verdict of Muadh. ** This Hadith is Sahih in its chain of narration, however, Imam Bukhari (may Allah have mercy upon him) and Imam Muslim (may Allah have mercy upon him) have not narrated it.
" حضرت زبیر رضی اللہ عنہ بیٹی اور بہن کے بارے میں یہ فتویٰ دیا کرتے تھے کہ سارا مال بیٹی کو دیا جائے گا ، میں نے کہا : حضرت معاذ رضی اللہ عنہ نے یمن میں ہمارے درمیان یہ فیصلہ کیا تھا کہ آدھا مال بیٹی کو اور آدھا بہن کو دیا جائے گا ۔ حضرت عبداللہ بن زیبر رضی اللہ عنہ نے فرمایا : تم میرے قاصد بن کر ولید بن عتبہ کے پاس جاؤ ( وہ ان دنوں کوفہ کے قاضی تھے ) ان کو کہنا کہ معاذ کے فتوے پر عمل کرے ۔ ٭٭ یہ حدیث صحیح الاسناد ہے لیکن امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ نے اس کو نقل نہیں کیا ۔"
Hazrat Zubair (رضي الله تعالى عنه) beti aur behan ke bare mein yeh fatwa diya karte thay keh sara maal beti ko diya jaye ga, maine kaha: Hazrat Muaz (رضي الله تعالى عنه) ne Yemen mein humare darmiyaan yeh faisla kiya tha keh aadha maal beti ko aur aadha behan ko diya jaye ga. Hazrat Abdullah bin Zubair (رضي الله تعالى عنه) ne farmaya: tum mere qasid ban kar Walid bin Utba ke paas jao (woh un dinon Kufa ke qazi thay) un ko kehna keh Muaz ke fatwe par amal kare. ** Yeh hadees Sahih Alisnad hai lekin Imam Bukhari Rahmatullah Alaih aur Imam Muslim Rahmatullah Alaih ne is ko naqal nahin kiya.
أَخْبَرَنَا أَبُو يَحْيَى السَّمَرْقَنْدِيُّ، ثَنَا مُحَمَّدُ بْنُ نَصْرٍ، ثَنَا يَحْيَى بْنُ يَحْيَى، ثَنَا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنِ الْأَسْوَدِ بْنِ يَزِيدَ، أَنَّهُ قَالَ: كَانَ ابْنُ الزُّبَيْرِ، يَقُولُ فِي ابْنَةٍ وَأُخْتٍ: الْمَالُ لِلِابْنَةِ فَقُلْتُ: «إِنَّ مُعَاذًا، قَضَى فِينَا بِالْيَمَنِ لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ» قَالَ: فَأَنْتَ رَسُولِي إِلَى الْوَلِيدِ بْنِ عُتْبَةَ - وَكَانَ قَاضِيَهُ عَلَى الْكُوفَةِ - فَمُرْهُ فَلْيَأْخُذْ بِذَلِكَ «هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ» [التعليق - من تلخيص الذهبي] 7972 - صحيح
