Mustadrak Al Hakim 7979
Abu Salma (may Allah be pleased with him) narrates: A man came to Abdullah bin Abbas (may Allah be pleased with both of them) and said: A man has passed away, leaving behind a daughter and a full sister (how will the inheritance be divided between them?). Abdullah bin Abbas (may Allah be pleased with both of them) said: The daughter will get half and the sister will get nothing. The man said: But Umar (may Allah be pleased with him) had given a different verdict in a similar case, he gave half to the daughter and half to the sister. Abdullah bin Abbas (may Allah be pleased with both of them) said: Do you know better or Allah? I couldn't understand the reason, then I met Ibn Taus and narrated the Hadith of Zahri to him. He told me that his father had told him that he had heard Abdullah bin Abbas (may Allah be pleased with both of them) saying that Allah Almighty said: "If a man dies, leaving no child, and he has a sister, then for her is half of what he leaves." (Quran 4:176) Abdullah bin Abbas (may Allah be pleased with both of them) said: Allah is giving the sister half in the case where there is no child, and you are saying that she will get half even if there is a child. ** This Hadith is Sahih (authentic) according to the criteria of Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) but both of them have not narrated it.
" حضرت ابوسلمہ رضی اللہ عنہ فرماتے ہیں : ایک آدمی حضرت عبداللہ بن عباس رضی اللہ عنہما کے پاس آیا اور اس نے کہا : ایک آدمی فوت ہو گیا ، اس نے ایک بیٹی اور ایک سگی بہن چھوڑی ، ( ان میں وراثت کیسے تقسیم کی جائے گی ؟ ) حضرت عبداللہ بن عباس رضی اللہ عنہما نے فرمایا : بیٹی کا آدھا اور بہن کے لیے کچھ نہیں ۔ اس آدمی نے کہا : لیکن حضرت عمر رضی اللہ عنہ نے تو اس سے مختلف فیصلہ کیا تھا ، انہوں نے بیٹی کو آدھا دیا اور بہن کو بھی آدھا دیا تھا ، حضرت عبداللہ بن عباس رضی اللہ عنہما نے فرمایا : تم زیادہ جانتے ہو یا اللہ تعالیٰ ؟ میں اس کی وجہ نہ سمجھ سکا ، پھر میں ابن طاؤس سے ملا ، اور ان کو زہری کی حدیث سنائی ، انہوں نے بتایا کہ میرے والد نے مجھے بتایا کہ انہوں نے حضرت عبداللہ بن عباس رضی اللہ عنہما کو یہ فرماتے ہوئے سنا ہے کہ اللہ تعالیٰ نے ارشاد فرمایا : إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَك ( النساء : 176 ) ’’ اگر کسی مرد کا انتقال ہو جو بے اولاد ہے اور اس کی ایک بہن ہو تو ترکہ میں اس کی بہن کا آدھا ہے ‘‘ ( ترجمہ کنزالایمان ، امام احمد رضا ) حضرت عبداللہ بن عباس رضی اللہ عنہما نے فرمایا : اللہ تعالیٰ تو بہن کو نصف اس صورت میں دے رہا ہے کہ اولاد نہ ہو اور تم کہتے ہو کہ اولاد ہونے کی صورت میں بھی اس کو نصف ملے گا ۔ ٭٭ یہ حدیث امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ کے معیار کے مطابق صحیح ہے لیکن شیخین رحمۃ اللہ علیہما نے اس کو نقل نہیں کیا ۔"
Hazrat Abusalama (رضي الله تعالى عنه) farmate hain : Ek aadmi Hazrat Abdullah bin Abbas ( (رضي الله تعالى عنه) a ke paas aaya aur usne kaha : Ek aadmi faut ho gaya, usne ek beti aur ek sagi bahan chhodi, ( in mein wirasat kaise taqsim ki jayegi? ) Hazrat Abdullah bin Abbas ( (رضي الله تعالى عنه) a ne farmaya : Beti ka aadha aur bahan ke liye kuchh nahin. Iss aadmi ne kaha : Lekin Hazrat Umar (رضي الله تعالى عنه) ne to isse mukhtalif faisla kiya tha, unhonne beti ko aadha diya aur bahan ko bhi aadha diya tha, Hazrat Abdullah bin Abbas ( (رضي الله تعالى عنه) a ne farmaya : Tum zyada jante ho ya Allah Ta'ala? Main iss ki wajah nah samajh saka, phir main Ibn Taus se mila, aur unko Zuhri ki hadees sunai, unhonne bataya ki mere walid ne mujhe bataya ki unhonne Hazrat Abdullah bin Abbas ( (رضي الله تعالى عنه) a ko ye farmate hue suna hai ki Allah Ta'ala ne irshad farmaya : In amru'un halaka laisa lahu waladun walahu ukhtun falaha nisfu ma taraka (Al-Nisa: 176) "Agar kisi mard ka intiqal ho jo be-aulad hai aur uski ek bahan ho to tarkah mein uski bahan ka aadha hai". (Tarjuma Kanzul Iman, Imam Ahmad Raza) Hazrat Abdullah bin Abbas ( (رضي الله تعالى عنه) a ne farmaya : Allah Ta'ala to bahan ko nisf iss surat mein de raha hai ki aulad na ho aur tum kahte ho ki aulad hone ki surat mein bhi usko nisf milega. ** Ye hadees Imam Bukhari Rahmatullah Alaih aur Imam Muslim Rahmatullah Alaih ke miyaar ke mutabiq sahih hai lekin Sheikhain Rahmatullah Alaihema ne isko naql nahin kiya.
أَخْبَرَنَا أَبُو يَحْيَى السَّمَرْقَنْدِيُّ، ثَنَا مُحَمَّدُ بْنُ نَصْرٍ الْإِمَامُ، ثَنَا إِسْحَاقُ، أَنْبَأَ عَبْدُ الرَّزَّاقِ، أَنْبَأَ مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ، قَالَ: جَاءَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا رَجُلٌ فَقَالَ: رَجُلٌ تُوُفِّيَ وَتَرَكَ بِنْتَهُ وَأُخْتَهُ لِأَبِيهِ وَأُمِّهِ، فَقَالَ: «لِابْنَتِهِ النِّصْفُ وَلَيْسَ لِأُخْتِهِ شَيْءٌ» قَالَ الرَّجُلُ: فَإِنَّ عُمَرَ رَضِيَ اللَّهُ عَنْهُ قَضَى بِغَيْرِ ذَلِكَ، جَعَلَ لِلِابْنَةِ النِّصْفَ وَلِلْأُخْتِ النِّصْفَ، قَالَ ابْنُ عَبَّاسٍ: «أَنْتُمْ أَعْلَمُ أَمِ اللَّهُ؟» فَلَمْ أَدْرِ مَا وَجْهُ هَذَا حَتَّى لَقِيتُ ابْنَ طَاوُسٍ، فَذَكَرْتُ لَهُ حَدِيثَ الزُّهْرِيِّ، فَقَالَ: أَخْبَرَنِي أَبِي، أَنَّهُ سَمِعَ ابْنَ عَبَّاسٍ، يَقُولُ: قَالَ اللَّهُ عَزَّ وَجَلَّ: {إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَ} [النساء: 176] قَالَ ابْنُ عَبَّاسٍ: «فَقُلْتُمْ أَنْتُمْ لَهَا النِّصْفُ وَإِنْ كَانَ لَهُ وَلَدٌ» هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ "" [التعليق - من تلخيص الذهبي] 7979 - على شرط البخاري ومسلم
