Chapter: Asking A Virgin For Permission With Regard To Marriage

باب اسْتِئْذَانِ الْبِكْرِ فِي نَفْسِهَا ‏.‏

Sunan an-Nasa'i 3260

Ummul Momineen Aishah (رضي الله تعالى عنها) narrated that the Apostle of Allah (صلى هللا عليه و آلهوسلم) married her when she was nine and he died when she was eighteen years old.

عبداللہ بن عباس رضی الله عنہما سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ”بیوہ عورت اپنے ولی ( سر پرست ) کے بالمقابل اپنے بارے میں فیصلہ کرنے کا زیادہ حق رکھتی ہے ۱؎ اور کنواری ( لڑکی ) سے اس کی شادی کی اجازت لی جائے گی۔ اور اس کی اجازت ( اس سے پوچھے جانے پر ) اس کا خاموش رہنا ہے“ ۲؎۔

Abdul-Allah bin Abbas ( (رضي الله تعالى عنه) a se riwayat hai ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: "Bewah aurat apne wali (sar perast) ke balmukabil apne bare mein faisla karne ka zyada haq rakhti hai 1، aur kunwari (larkI) se is ki shadi ki ijazat li jaegi. Aur is ki ijazat (is se pooche jane per) is ka khamosh rehna hai" 2،.

أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا ‏"‏ ‏.‏

Sunan an-Nasa'i 3261

Umar bin Al-Khattab, may Allah be pleased with him, narrated: Hafsah bint 'Umar became single when (her husband) Khunais bin Hudhafah As-Sahmi (died). He was one of the Companions of the Prophet, and he died in Al-Madinah. Umar said: I went to 'Uthman bin 'Affan and offered Hafsah in marriage to him. I said: 'If you wish, I will marry you to Hafsah bint 'Umar.' He said: 'I will think about it.' A few days passed, then I met him and he said: 'It seems that I do not want to get married at the moment.' 'Umar said: Then I met Abu Bakr As-Siddiq, may Allah be pleased with him, and said: 'If you wish, I will marry Hafsah bint 'Umar to you.' Abu Bakr remained silent, and did not give me any answer, and I felt more upset with him than I had with 'Uthman. Several days passed, then the Messenger of Allah proposed marriage to her and I married her to him. Abu Bakr met me and said: 'Perhaps you felt upset with me when you offered Hafsah in marriage to me, and I did not give you any answer?' I said: 'Yes.' He said: 'Nothing prevented me from giving you an answer when you made the offer to me, except the fact that I had heard the Messenger of Allah speak of her, and I did not want to disclose the secret of the Messenger of Allah. If he had left her, then I would have married her.'

عبداللہ بن عباس رضی الله عنہما سے روایت ہے کہ نبی اکرم ﷺ نے فرمایا: ”بیوہ اپنے ولی ( سر پرست ) کے بالمقابل اپنے ( رشتہ کے ) بارے میں فیصلہ کرنے کا زیادہ حق رکھتی ہے۔ اور «یتیمہ» یعنی کنواری لڑکی سے ( اس کی شادی کے لیے ) اس کی منظوری لی جائے گی اور اس کی منظوری ( پوچھے جانے پر ) اس کی خاموشی ہے“۔

Abdul-Allah bin Abbas ( (رضي الله تعالى عنه) a se riwayat hai ke Nabi-e-Akram (صلى الله عليه وآله وسلم) ne farmaya: "Bewah apne wali (sar-e-parast) ke balmukabil apne (rishta ke) bare mein faisla karne ka ziyada haq rakhati hai. Aur «yateema» yani kunwari ladki se (is ki shadi ke liye) is ki manzuri li jae gi aur is ki manzuri (poochhe jaane per) is ki khamoshi hai“.

أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلاَنَ، قَالَ حَدَّثَنَا أَبُو دَاوُدَ، قَالَ حَدَّثَنَا شُعْبَةُ، عَنْ مَالِكِ بْنِ أَنَسٍ، قَالَ سَمِعْتُهُ مِنْهُ، بَعْدَ مَوْتِ نَافِعٍ بِسَنَةٍ وَلَهُ يَوْمَئِذٍ حَلْقَةٌ قَالَ أَخْبَرَنِي عَبْدُ اللَّهِ بْنُ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏"‏ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ وَإِذْنُهَا صُمَاتُهَا ‏"‏ ‏.‏

Sunan an-Nasa'i 3262

Ibn Abbas (رضي الله تعالى عنه) narrated that the Apostle of Allah (صلى الله عليه وآله وسلم) said, a previously married woman has more right to decide about herself (with regard to marriage) than her guardian, and a virgin should be asked for permission with regard to marriage, and her permission is her silence.’


Grade: Sahih

عبداللہ بن عباس رضی الله عنہما سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ”بیوہ عورت اپنے نفس کی خود مالک ہے۔ ( شادی کرے گی ) اور «یتیمہ» یعنی کنواری لڑکی سے ( اس کی شادی کے لیے ) اس کی منظوری لی جائے گی اور اس کی منظوری ( پوچھے جانے پر ) اس کی خاموشی ہے“۔

Abdullah bin Abbas Radi Allahu Anhuma se riwayat hai ki Rasul Allah ﷺ ne farmaya: ”Bewa aurat apne nafs ki khud malik hai. (Shadi karegi) Aur «Yateema» yani kunwari ladki se (Is ki shadi ke liye) is ki manzoori li jayegi aur is ki manzoori (Pooche jane par) is ki khamoshi hai”.

أَخْبَرَنِي أَحْمَدُ بْنُ سَعِيدٍ الرِّبَاطِيُّ، قَالَ حَدَّثَنَا يَعْقُوبُ، قَالَ حَدَّثَنِي أَبِي، عَنِ ابْنِ إِسْحَاقَ، قَالَ حَدَّثَنِي صَالِحُ بْنُ كَيْسَانَ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ بْنِ عَبَّاسِ بْنِ رَبِيعَةَ، عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ الأَيِّمُ أَوْلَى بِأَمْرِهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا ‏"‏ ‏.‏

Sunan an-Nasa'i 3263

It was narrated from Ibn 'Abbas that the Prophet said: "A previously married woman has more right to decide about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted, and her permission is her silence."


Grade: Sahih

عبداللہ بن عباس رضی الله عنہما کہتے ہیں کہ نبی اکرم ﷺ نے فرمایا: ”بیوہ ( غیر کنواری ) عورت پر ولی کا کچھ اختیار نہیں ہے، اور «یتیمہ» کنواری لڑکی سے اس کی ذات کے بارے میں مشورہ ( و اجازت ) لی جائے گی، اور ( جواباً ) اس کی خاموشی اس کی اجازت مانی جائے گی“۔

Abdul'lah bin Abbas ( (رضي الله تعالى عنه) a kehte hain ke Nabi-e-Akram (صلى الله عليه وآله وسلم) ne farmaya: “Beva ( ghair kunwari ) aurat per wali ka kuchh ikhtiyar nahin hai, aur “yatim'a” kunwari lar ki se is ki zat ke bare mein mashawarah ( wa ijazat ) li jayegi, aur ( jawab'an ) is ki khamoshi is ki ijazat mani jayegi”.

أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ، قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ، قَالَ أَنْبَأَنَا مَعْمَرٌ، عَنْ صَالِحِ بْنِ كَيْسَانَ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏"‏ لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ فَصَمْتُهَا إِقْرَارُهَا ‏"‏ ‏.‏
