Book of Divorce

كِتَابُ الطَّلَاقِ

What they said about the man who places the matter of his wife in her own hands and she divorces herself.

‌مَا قَالُوا: فِي الرَّجُلِ يَجْعَلُ أَمْرَ امْرَأَتِهِ بِيَدِهَا فَتُطَلِّقُ نَفْسَهَا

Musannaf Ibn Abi Shaybah 18082

Hazrat Ibn Umar (may Allah be pleased with him) said that if a woman is given the right to choose, then whatever decision she makes will be considered valid. If anyone refuses to accept her decision, then they should be made to swear an oath.

حضرت ابن عمر (رض) فرماتے ہیں کہ اختیار دیئے جانے کی صورت میں جو فیصلہ بیوی کرے وہی نافذ ہوگا، اگر کوئی انکارکرے تو اس سے قسم لی جائے گی۔

Hazrat Ibn Umar (RA) farmate hain keh ikhtiyar diye jane ki soorat mein jo faisla biwi kare wohi nafiz hoga, agar koi inkar kare to us se qasam li jaye gi.

حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا حُمَيْدُ بْنُ عَبْدِ الرَّحْمَنِ ، عَنْ حَسَنٍ ، عَنْ مُجَالَدٍ ، عَنِ الشَّعْبِيِّ ، فِي رَجُلٍ جَعَلَ أَمْرَ امْرَأَتِهِ بِيَدِهَا ، قَالَ : « الْقَضَاءُ مَا قَضَتْ »
