Book of Divorce

كِتَابُ الطَّلَاقِ

Concerning the man who permits his slave to marry, who said: The divorce is in the hands of the slave.

‌فِي الرَّجُلِ يَأْذَنُ لِعَبْدِهِ فِي النِّكَاحِ، مَنْ قَالَ: الطَّلَاقُ بِيَدِ الْعَبْدِ

Musannaf Ibn Abi Shaybah 18285

Prophet Muhammad (peace be upon him) said that the right to divorce belongs to the one who has the right to the intimacy.

حضرت محمد (صلی اللہ علیہ وآلہ وسلم) فرماتے ہیں کہ طلاق کا اختیار اسی کو ہوگا جو شرمگاہ کا حق رکھتا ہے۔

Hazrat Muhammad (Sallallahu Alaihi Wasallam) farmate hain keh talaq ka ikhtiyar usi ko hoga jo sharamgah ka haq rakhta hai.

حَدَّثَنَا أَبُو أُسَامَةَ ، عَنِ ابْنِ عَوْنٍ ، عَنْ مُحَمَّدٍ قَالَ : « الطَّلَاقُ بِيَدِ مَنْ يَمْلِكُ الْبُضْعَ »
