كِتَابُ الطَّلَاقِ
Concerning the man who permits his slave to marry, who said: The divorce is in the hands of the slave.
فِي الرَّجُلِ يَأْذَنُ لِعَبْدِهِ فِي النِّكَاحِ، مَنْ قَالَ: الطَّلَاقُ بِيَدِ الْعَبْدِ
Musannaf Ibn Abi Shaybah 18288
Hazrat Zahak (R.A) said: "Whoever gets his slave man married to his slave woman with her consent in the presence of witnesses, he cannot separate them, and until death, it is not permissible for him to have sexual relations with this slave woman."
حضرت ضحاک (رض) فرماتے ہیں کہ جس شخص نے اپنے غلام کی اپنی باندی سے مہر کے ساتھ گواہوں کی موجودگی میں شادی کرادی تو وہ اس سے چھین نہیں سکتا، اور موت تک اب اس باندی کی شرمگاہ اس کے لیے حلال نہیں۔
Hazrat Dahak (RA) farmate hain ke jis shakhs ne apne ghulam ki apni bandi se mehr ke sath gawahon ki mojoodgi mein shadi karadi to woh usse chheen nahin sakta, aur maut tak ab is bandi ki sharamgah uske liye halal nahin.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا أَبُو أُسَامَةَ ، عَنْ جُوَيْبِرٍ ، عَنِ الضَّحَّاكِ قَالَ : « مَنْ زَوَّجَ عَبْدَهُ أَمَةً بِمَهْرِ بِنْتِهِ ، لَا يَصْلُحُ لَهُ أَنْ يَنْزِعَهَا مِنْهُ ، وَلَا يَحِلُّ لَهُ فَرْجُهَا حَتَّى يَمُوتَ »
