١٤-
كِتَابُ الطَّلَاقِ Concerning the man who permits his slave to marry, who said: The divorce is in the hands of the slave.
فِي الرَّجُلِ يَأْذَنُ لِعَبْدِهِ فِي النِّكَاحِ، مَنْ قَالَ: الطَّلَاقُ بِيَدِ الْعَبْدِ
Musannaf Ibn Abi Shaybah 18287
Hazrat Zuhri (may Allah have mercy on him) said that if the master has arranged the marriage of his slave or has given him permission to marry, then the right of divorce will belong to the slave.
حضرت زہری (رض) فرماتے ہیں کہ اگر آقا نے غلام کی شادی کرائی یا اسے شادی کی اجازت دی تو طلاق کا حق غلام کو ہوگا۔
Hazrat Zahri (RA) farmate hain keh agar aaqa ne ghulam ki shadi karaai ya usay shadi ki ijazat di to talaq ka haq ghulam ko hoga.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا عَبْدُ الْأَعْلَى ، عَنْ مَعْمَرٍ ، عَنِ الزُّهْرِيِّ قَالَ : « إِذَا زَوَّجَ الرَّجُلُ عَبْدَهُ أَوْ أَذِنَ لَهُ فِي التَّزَوُّجِ ، فَإِنَّ الطَّلَاقَ بِيَدِ الْعَبْدِ »
