Book of Divorce
١٤-
كِتَابُ الطَّلَاقِ
Who said: If the slave marries without the master's permission, the divorce is in the master's hands.
مَنْ قَالَ: إِذَا تَزَوَّجَ الْعَبْدُ بِغَيْرِ إِذْنِ السَّيِّدِ فَالطَّلَاقُ بِيَدِ السَّيِّدِ

Hazrat Shabi (may Allah be pleased with him) said that if a slave marries without the permission of his master, then the master has the right to divorce, and if he marries with the master's permission, then the slave has the right to divorce.
حضرت شعبی (رض) فرماتے ہیں کہ اگر غلام نے آقا کی اجازت کے بغیر شادی کی تو طلاق کا حق آقا کو ہوگا، اور اگر آقا کی اجازت سے شادی کی تو طلاق کا حق غلام کو ہوگا۔
Hazrat Shabi (RA) farmate hain keh agar ghulam ne aqa ki ijazat ke baghair shadi ki to talaq ka haq aqa ko hoga, aur agar aqa ki ijazat se shadi ki to talaq ka haq ghulam ko hoga.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا وَكِيعٌ ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ ، عَنِ الشَّعْبِيِّ قَالَ : « إِذَا تَزَوَّجَ الْعَبْدُ بِغَيْرِ إِذْنِ سَيِّدِهِ فَالطَّلَاقُ بِيَدِ السَّيِّدِ ، وَإِذَا تَزَوَّجَ بِإِذْنِهِ فَالطَّلَاقُ بِيَدِ الْعَبْدِ »
