كِتَابُ الطَّلَاقِ

Who said: If he swears for less than four months, he is still considered to be abstaining?

‌مَنْ قَالَ: إِذَا حَلَفَ عَلَى دُونِ الْأَرْبَعَةِ فَهُوَ مُولٍ

Musannaf Ibn Abi Shaybah 18593

Hazrat Hammad (RA) said that if a person said to his wife, "By God! I will not come near you today," and then he stayed away from her for four months, then it will be considered as Ila.

حضرت حماد (رض) فرماتے ہیں کہ اگر کسی شخص نے اپنی بیوی سے کہا کہ خدا کی قسم ! میں آج تیرے قریب نہیں آؤں گا اور پھر چار مہینے تک اسے چھوڑے رکھا تو یہ ایلاء ہے۔

Hazrat Hammad (RA) farmate hain ke agar kisi shakhs ne apni biwi se kaha ke Khuda ki qasam ! mein aaj tere qareeb nahin aaoon ga aur phir chaar mahine tak use chhore rakha to yeh ila hai.

حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا جَرِيرٌ ، عَنْ مُغِيرَةَ ، عَنْ حَمَّادٍ قَالَ : " إِذَا قَالَ الرَّجُلُ لِامْرَأَتِهِ : وَاللَّهِ لَا أَقْرَبُكَ الْيَوْمَ ، فَتَرَكَهَا أَرْبَعَةَ أَشْهُرٍ فَهُوَ إِيلَاءٌ "
