كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ

Regarding profit-sharing ventures and the deposit of entrusted items.

‌فِي الْمُضَارَبَةِ وَالْعَارِيَّةِ الْوَدِيعَةِ

Musannaf Ibn Abi Shaybah 21463

Hazrat Abu Qilaba said that if some conditions are imposed on the worker and he is told not to violate them, then if he violates them, he will be held responsible.

حضرت ابو قلابہ فرماتے ہیں کہ اگر مضارب پر کچھ شرائط لگائی جائیں کہ ان سے تجاوز نہ کرنا، اگر وہ پھر بھی کرلے تو وہ ضامن ہوگا۔

Hazrat Abu Qalaba farmate hain keh agar muzarab per kuch sharait lagai jaen keh un se tajawuz na karna, agar woh phir bhi karle toh woh zaman hoga.

حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ ، عَنْ خَالِدٍ ، عَنْ أَبِي قِلَابَةَ ، فِي الْمُضَارِبِ إِذَا اشْتَرَطُوا عَلَيْهِ لَا يُجَاوِزَ ، فَجَاوَزَ ، فَهُوَ ضَامِنٌ "
