كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ
The condition of liability in a trade partnership.
شَرْطُ الضَّمَانِ فِي الْمُضَارَبَةِ

It was asked of Hazrat Ata regarding a person who gives money to someone for Mudarabah (profit-sharing partnership) on the condition that he (the one receiving the money) will also be the guarantor of that money. He (Hazrat Ata) replied that he will not be a guarantor.
حضرت عطاء سے اس شخص کے متعلق دریافت کیا گیا جو کسی کو مال مضاربت اس شرط پردے کہ وہ اس مال کا ضامن بھی ہوگا تو انھوں نے جواب دیا کہ وہ ضامن نہیں ہوگا۔
Hazrat Ata se iss shakhs ke mutalliq puchtaach ki gayi jo kisi ko maal mudarabat iss shart par de ke woh iss maal ka zaamin bhi hoga to unhon ne jawab diya ke woh zaamin nahin hoga.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا الضَّحَّاكُ بْنُ مَخْلَدٍ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَطَاءٍ : فِي الرَّجُلِ يَدْفَعُ إِلَى الرَّجُلِ مَالًا مُضَارَبَةً أَنَّهُ ضَامِنٌ قَالَ : « لَيْسَ بِضَامِنٍ »
