كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ
The condition of liability in a trade partnership.
شَرْطُ الضَّمَانِ فِي الْمُضَارَبَةِ
Musannaf Ibn Abi Shaybah 22655
It was asked to Hazrat Hasan that a person gave another person money for Mudarabah (profit-sharing partnership) and made him a guarantor. He (Hazrat Hasan) said: "The profit will be divided between the two of them and no attention will be paid to his guarantee."
حضرت حسن سے دریافت کیا گیا کہ ایک شخص نے دوسرے کو مال مضاربت دیا اور اس کو ضامن بنایا ؟ آپ نے فرمایا : جو نفع ہے وہ ان دونوں کے درمیان تقسیم ہوگا اور اس کے ضمان کی طرف التفات نہ کیا جائے گا۔
Hazrat Hassan se daryaft kya gaya keh aik shakhs ne dusre ko mal mudarabat diya aur us ko zamin banaya? Aap ne farmaya: Jo nafa hai wo in donon ke darmiyaan taqsim hoga aur us ke zaman ki taraf iltifaat na kya jaye ga.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا غُنْدَرٌ ، عَنْ أَشْعَثَ ، عَنِ الْحَسَنِ ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ دَفَعَ إلَى رَجُلٍ مَالاً مُضَارَبَةً وَضَمَّنَهُ إيَّاهُ ، قَالَ : الرِّبْحُ بَيْنَهُمَا ، وَلَا يُلْتَفَتُ إلَى ضَمَانِهِ .
