Musannaf Ibn Abi Shaybah 22722
The Holy Presence (peace be upon him and his progeny) has said, "The pre-emptor is more deserving (of the property) than the neighbor, and the neighbor is more deserving than the distant one." (Or it means: If the pre-emptor is a neighbor, then he is more deserving, and if the neighbor is also close, then he is even more deserving).
حضور اقدس (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : شفعہ کرنے والا پڑوسی سے زیادہ حق دار ہے اور پڑوسی نزدیک والے سے زیادہ حق دار ہے۔ (یا پھر یہ مطلب ہے کہ شفعہ کرنے والا پڑوسی ہو تو وہ زیادہ حق دار ہے اور پڑوسی نزدیک بھی ہو تو زیادہ حق دار ہے) ۔
Huzoor Aqdas (Sallallahu Alaihi Wa Aalihi Wasallam) ne irshad farmaya : Shuf'a karne wala padosi se zyada haqdaar hai aur padosi nazdeek wale se zyada haqdaar hai. (Ya phir ye matlab hai ke shuf'a karne wala padosi ho to wo zyada haqdaar hai aur padosi nazdeek bhi ho to zyada haqdaar hai).
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا وَكِيعٌ ، عَنْ هِشَامِ بْنِ الْمُغِيرَةِ الثَّقَفِيِّ ، قَالَ : سَمِعْتُ الشَّعْبِيَّ ، يَقُولُ : قَالَ رَسُولُ اللَّهِ ﷺ : « الشَّفِيعُ أَوْلَى مِنَ الْجَارِ ، وَالْجَارُ أَوْلَى مِنَ الْجُنُبِ »
